A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 10.22 SUBDIVISION 1(B)
AND SECTION 10.56 SUBDIVISION 16(C)(� ;
FILE NO. 03-2899 �
WHEREAS, Timothy Pellizer, a single person, (hereinafter "the applicant")is the
owner of the property located at 520 North Arm Drive within the City of Orono (hereinafter the
"City") and legally described as follows:
Lot 3,Block 1,Victoria Estates,Hennepin County,Minnesota
(hereinafter the "property"); and
WI�EREAS,the applicant has made application to the City of Orono for a variance
• to Orono Municipal Zoning Code Sections 10.22,Subdivision 1(B)and 10.56,Subdivision 16(C)(6)
to allow construction of an addition to the existing residence,such addition encroaching as much as
68'past the defined average lakeshore setback line where no encroachment is normally allowed.
NOW, THEREFORE SE IT� RESOI,VED by the City Council of Orono,
Minnesota: -
� FINDINGS
1. This application was reviewed as Zoning File#03-2899.
2. The property is located in the LR-lA Lakeshore Residential Zoning District,which
requires minimum lot area of 2.0 acres and minimum lot width of 200'. The lot �
conforms to width and area requirements.
3. The Planning Commission reviewed this application at a public hearing held on
June 16,2003 and recommended approval of the average lakeshore setback variance
based on the following findings:
a) No neighboring property's lake views would be negatively impacted by the �
proposed garage addition.

b) The existing trench septic system is located such that the proposed garage and
especially its apron and the fill needed to create the apron,will encroach into
the existing drainfield axea. The system must be relocated before construction
of the addition commences. � .
c) The proposed addition meets all other pertinent City codes.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission,reports by City staff, comments by
the applicant and the public, and the effect of the proposed variance on the health,
safety and welfaze of the community.
5. The City Council finds that the conditions existing on this property are peculiar to it
and do not apply generally to other property in this zoning district;that granting the
variance would not adversely affect traffic conditions,light,air nor pose a fire hazard
: � or other danger to neighboring property;would not merely serve�as a convenience to
the applicant,but is necessary to alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the applicant; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the
City. .
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings,the Orono City Council hereby grants
a variance to Orono Municipal Zoning Code Section 10.22 Subdivision 1(B) and Section 10.56 ,
Subdivision 16(C)(6) to allow construction of an addition to the existing residence, such addition �
encroaching as much as 68'past the defined average lakeshore setback line where no encroachment �
is normally allowed, subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicant, attached to this
. Resolution as Exhibit A. Any amendments to the site plan which are not in conformity with
City codes will require further Planning Commission and City Council review.
2. Prior to issuance ofbuilding permits for the addition,applicant shall confirm that the property
contains primary and alternate sites for replacement of the septic system, and shall replace
• said system in conjunction with construction of said addition.

3. Authorities granted by this resolution run with the property not with the applicant, but are
pernussive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire on
that date(June 23, 2004). .
4. Violation of or non-compliance with any of the terms and conditions of this resolution shall
constitute a violation of the zoning code,shall automatically terminate any authority granted
herein, and shall be punishable as a misdemeanor.
5. The undersigned applicant has read, understood and hereby agrees to the terms of this
resolution and on behalf of the applicant and the applicant's heirs, successors and assi�s,
� hereby agrees to the recording of this resolution in the chain of title of the property.
Adopted by the Orono City Council on this 23rd day of June, 2003.
