Melanie,
I stopped by 520 North Arm and reviewed the area of the proposed buffer. The buffer currently does not meet the
requirements of the wetland ordinance. It is seeded to turf(sparse) and has thistles that have developed. Brenda (nice
lady) the home owner was home and I discussed what needed to be done. I recommended that they cut the thistle so it
does not go to seed and spray it in early fall when it is more susceptible to herbicide. It sounds like they will try to seed
it on their own so I recommended that they spray the turf and complete a dormant seeding late this fall so the snow will
work the seed into the ground. I provided sources of native seed.
I indicated I would need to come back next year to review the buffer after it has been seeded.

Soren &John -Tim Pellizzer has requested a CO for his property at 520 North Arm Drive. This project triggered the
wetland regulations—buffer and easements.
Soren - If you remember, I think Bruce Malkerson called you about this wetland and conservation easement. It has kind
of been at a stand-still since then... Do you know where it was left? Evelyn has a note in the file that says you were
discussing the easement issue with the property owner's attorney in October of 2008.
John—can you verify compliance with wetland regs?

This is a new house that was started a year ago. Willie says it is progressing slowly. They
are just nearing time for a framing inspection. Willie noticed that the buffer area and buffer
setback has been cleared by grading. Your report indicated the buffer was turf. The
approved plan calls for removing undesirable vegetation with roundup and burning. When
you are in the area would you check the site to see if what they have done would be an
acceptable alternative to the plan.

Evelyn,
I believe we can allow the trail in the buffer per Sec. 78-1606 which allows boardwalks, docks or other reasonable
access to the wetland not exceeding 8 feet in width. I would consider the wood chip trail a reasonable access
which does not increase the impervious surface. Currently people walk across his lawn. The owner called me
prior to the submittal and I provided him with the criteria that the trail would need to be 8 feet or less.

This property has a joint dock. So in addition to the access trail to the dock there is trail through the buffer to the
property to the north. (See attachment.)The owner says there is already a trail there. Did you know about this?

I received it yesterday and sent it on to Darren Amundsen at Bonestroo. I had wondered
why the house had moved farther from the easement. I have asked Darren if the easement
can be moved east to be centered on the sewer line. If it can the house could be shifted
back. But don't do anything until we hear from Darren. Once we know where the easement
will be all eaves and parts of the foundation must be clear of the easement.
The only thing more I would need is an 11 x17 print of the survey, but wait until we have
heard from Darren before you have Gronberg send one down.

good sense to fill more and he had done what should be done for the land. Have you

The updated vegetative restoration plan for the wetland buffer meets the requirements of
the wetland ordinance. Per section 78-1602 (3) F of the ordinance a cash escrow or letter
of credit of $4800 will need to be provided to cover compliance checks and replace any
vegetation that dies. Once found to be in compliance the remaining amount in the escrow
or letter of credit can be returned to the owner.

I have looked at the new house permit application in more detail and find the
following issues that need to be addressed:
1. The house is three defined stories. See the third attachment. It may exceed
30' defined height. See second attachment for how building height and stories
are calculated.
2. Survey does not satisfy the City's minimum requirements. See the second
attachment for these standards. When it is revised the delineated wetland
should be shown on it and a legal description of the wetland provided.
Mr. Nowak uses the word "architectural" on the plans but does not appear on the
roster of licensed Architects as of August 1.
When the owner signed the demo permit she indicated the shed on the property
would not be removed. Now I understand it will be. The last attachment is a scan on
the back side of the application. The owner should initial by where the shed was
added to the permit. You should bring it with you when you pick up the demo
permit.

This morning at 9:30, I had a conversation with Willy from the City of Orono regarding Mr. Pellizzer"s request to
not remove the storage building that is currently located on the alternate septic site. During initiai conversations
with Willy, when he raised a concern regarding the storage building, I stated that if it was required to remove the
building to gain approval of our overall septic design we would. This statement became to be understood that we
would remove the building. This was mistaken. It later became documented on our permit application that the
building was to be removed. In my conversation with Will this morning, he stated that he did not have an issue
with the present storage building and would not hold back approval of our septic design with the building as
located. Willy did offer that there may be an issue with "hardcover" calculations and City Ordinance limits. I have
asked Demars-Gabriel Surveyors to include the present storage building in the revised calculations they have
included on the attached survey. I did not receive a call from Robert at Demars-Gabriel stating that there was a
conflict with the limits of hardcover, so I am assuming that we are within limits. Please advise me if there are
further issues with the detached existing storage building.

This moming at 9:30, I had a conversation with Willy from the City of Orono regarding Mr. Pellizzer"s
request to not remove the storage building that is currently located on the alternate septic site. During
initial conversations with Willy, when he raised a concern regarding the storage building, I stated that if it
was required to remove the building to gain approval of our overall septic design we would. This statement
became to be understood that we would remove the building. This was mistaken. It later became
documented on our permit application that the building was to be removed. In my conversation with Will
this morning, he stated that he did not have an issue with the present storage building and would not hold
back approval of our septic design with the building as located. Willy did offer that there may be an issue
with "hardcover" calculations and City Ordinance limits. I have asked Demars-Gabriel Surveyors to include
the present storage building in the revised calculations they have included on the attached survey. I did
not receive a call from Robert at Demars-Gabriel stating that there was a conflict with the limits of
hardcover, so I am assuming that we are within limits. Please advise me if there are further issues with the
detached existing storage building.
Please advise me of any additional information you may need as I wish to keep the processing of this
permit application moving ahead.

I think I heard Mike mention, during our speaker phone conversation, "splitting the file". I understood this to
mean that a portion of the flle would be moved to another department for parallel rather than linear processing.
Again, my understanding of this"splitting"was to help make up some lost time. Did this happen?

We have reviewed the grading plan for 520 North Arm Drive, dated 8-15-08. The plans proposed to remove
an existing home and construct a new home with an attached garage. We have the following comments
with regards to engineering matters:
• The survey should show the existing home and garage, if they are still standing.
• Existing contours should be provided for the entire lot, including over the driveway. Contours
should extend at least 50' beyond all property lines.
• All proposed grading should be shown on the survey. It appears all contours currently shown are
existing.
• Detailed and engineered retaining wall design and details should be submitted for all retaining
walls over 4' in height. This would apply to the proposed wall to the north of the garage,
• All trees to be removed should be labeled.
• A detail for silt fence with steel T-posts should be shown on the plans.
• There are two manholes shown to the south of the garage, More information is needed for these
manholes, including what type of manholes they are, inverts, type, size, and direction of any pipe
connected to the manholes.

Remarks:
The wetland ordinance requires wetland buffers due to the proposed new home. -
There is one wetland located within the propeny. The wetland is classified as a preseroe which
requires a 50 foot buffer and 20 foot setback fram the buffer. �
BufFer Condition and Requirements � _
A site evaluation was completed on 9 September 2008 and it was determined that the buffer
within the property is turf grass. Per Div. 3 Sec. 78-1605(2){a)turf grass is considered an
undesirable plant species and will need ta be removed and replaced with native vegetation.
The applicant will need to provide a ManagementlLandscaping plan that includes the fallowing: �
1. Method of establishing native vegetation in the buffer that is turf, {MN BWSR Web
Site—Publication: "Restoring&Managing Native Wetland and Upland Vegetation"
source for options).
2. Species proposed to be seeded or planted,According ta the ordinance Div. 3 Sec. 78-
i 6Q5(3)the seed mix must contain at least 12 pounds(PLS)per acre of native prairie
grass seed and 5 pounds(PLS)per acre of native wildflower seed. Pfative prairie grass
and native forb maes shall contain no fewer than faur(4)and five(5)species
respectively(MN BWSR Web Site—Publication: "Restoring&Managing Native
Wetland and Upland Vegetation" source for options).
3. A schedule of activities that are part of the management and maintenance for the
establishment of vegetation in the buffer shall be provided. -
Sunrey Requirements
A boundary depicting the upslope edge of the buffer needs to be shown on the certificate of -
survey. A legal description for the upslope edge of the buffet will need to be submitted witt�
the Restridions and Covenants(see description below).
Restriction and Covenant for Wetiand and Buffer
Per Section 78-1611 of the wetland ordinante the owner shall record Resviction and
Covenants aver the wetland and buffer with the properry chain of title. A farm with the
language fo�the Restriction and Covenants is available ftom the City.

Wetfand Buffer Markers
Formal buffer markers are not required for the p�oposed adivity under the Ordinance, however
it is recommended that the buffer is marked by the applicant so they can be avoided during
native vegetation development and for review during the vegetation establishment period
(approx. 2 years).
Wetland Water Quafity Treatrnent Requiremems
The buffer will provide adequate treatment for the proposed use of the properry.
Recommendations
It is recommended that this application not be approved until issues presented in this memo are
addressed. An escrow amount for the buffer will be developed after the landscape and -
management plan is submitted.

development of your site north of the City of Mound and to provide wetland-permitting
documentation in order to comply with the Minnesota Wetland Conservation Act(WCA)
and the Clean Water Act Section 404. The site is approximately 2.78 acres,north of
North Arm Drive. The site is Lot 3, Block 1, Victoria Estates. One (�)wetland was
delineated. The site is located in the Minnehaha Creek Watershed, north of Mound in
Hennepin County,Minnesota. This report describes the chazacteristics of the wetland
basin and documents its status under the various wetland regulations. If your project will
not impaet the wetland, or is below the tilreshold limits outlined below, this report can be
submitted to the Local Units of Government to document compliance with the vasious

The basin was field delineated(on-site)November 21,2006 using the principles of the
1987 Corps of Engineers Wetland Delineation Manual including adopted modifications,
guidance letters and memorandum of agreement. The routine delineation method was
generally used and dominant vegetation was evaluated by estimated area cover and the
50/20 rule. Wetlands were classified according to the methodologies in Wetland and
Deepwater Habitats of the United States(FWS/OBS Publication 79/31; Cowardin et. al.
1979)and Wetlands of the United States (USFWS Circular 39; Shaw and Fredin 1971).
The wetland boundaries and observation points were staked with pink metal flagging.
The locations of the staked basins were surveyed by Demars-Gabriel Land Surveyors Inc.
and incorporated into the site plans.

Wetland 1 is a Palustrine Emergent, Saturated(PEMB, Type 2) fringe wetland directly
adjacent to North Arm Bay a deep water habitat northerly of the existing house. The
fringe wetland consisted of Reed Canary Grass, Common Cattails and Red Osier
Dogwood. Saturated soils and standing water was observed near the surface. The adjacent
uplands were marked by a distinet topographic and vegetation break consisting of
Kentucky Blue Gra.ss, Common Dandelion, Canada Thistle and Black Seed Plantain.
There is a remnant large White Oak that had faller�near the wetland boundary,
Wetland Jurisdiction
Clean Water Act. Section 404
The U.S. Army Corps of Engineers(COE)regulates dred�e and fill activities in
navigable waters,wetlands adjacent, tributary, or with significant nexus to
navigable waters and isolated wetlands important to interstate commerce. A 2001
Supreme Court ruling has limited the COE jurisdiction over isolated wetlands,but
the COE has not yet finalized guidance for implementing this ruling under Section
404 of the Clean Water Act. In most cases, if the proposed impacts are less than
400 square feet,the COE does not require notification of the project. If proposed
impacts are between 400 square feet and 2.0 acres,the COE requires notification
and approval (letter of permission)prior to beginning the project. If the wetland
impacts occur in or adjacent to "special waters"andlor exceed 10,000 square feet,
the COE review will include a 30-day public/interagency notice. If the proposed
impacts exceed the WCA deminimus limits (see below),the COE will require
.
mitigation for the full aznount of the impacts regardless of the WCA exemption. If
more than two acres of wetland impacts aze proposed, an individual permit will
automatically be required which includes sequencing(providing there are no
alternatives)review by other environmental agencies, a public comment period,
and compensatory mitigation. The COE contact person for Hennepin County is

Minnesota Frotected Waters Act
The Department of Natural Resources (DNR)has jurisdiction over waters of the
state that aze generally Wetland Type 3,4,and 5, and aze larger than 2.5 acres in
incorporated areas or 10 acres in unincorporated azeas. There is one DNR
protected wetland listed on this site,wetland# 1 (the North Arm)with an
Ordinary High Water(OHV� level of 929.4 established. The OHW for a lake or
wetland is determined by the DNR as the elevation at which the vegetation
changes from aquatic to terrestrial. For a watercourse the OHW is the average
elevation of the top of the channel banks at any given location. The DNR has
jurisdiction over areas below the OHW.No impacts are allowed below the OHW
which would have the effect of converting protected waters to upland. Although
some activities such as vegetation clearing, sand blankets, docks, etc. may be
allowed by the DNR,they may require a permit and the DNR should be consulted
as to limitation on any activity below the OHW. The DNR contact is Tom Hovey

Minnesota Wetland Conservation Act(WCA�
A Local Unit of Government(LGU)will have jurisdiction over the wetlands on
the site, based on the WCA as amended through 2000. The LGU for this site is the
Minnehaha Creek Watershed(Eric Evenson,(952-471-0590). There is a WCA
deminimis exemption for the project for the first 2,000 square feet of wetland
impacts to Type 1, 2, and 6 wetlands outside of a shoreland protection zone.
Within a shoreland protection zone (1,000 feet for a lake and 300 feet from a
river)and for other types of wetlands the deminimus exemption is limited to 400
square feet. If the site plans include wetland impacts,which exceed the exemption
limits, a WCA permit will be required from the County. Under the WCA rules, an
applicant must demonstrate that wetland impacts have been avoided and
unavoidable impacts minimized before the activity would be permitted. These
rules also require a 2:1 mitigation ratio for fillin�or drainin in anv wetland, or
excavation in semi permanentl�to permantel ��flooded wetlands Projects with
proposed wetland impacts must also develop a 5-yeaz monitoring plan to
determine if the mitigation plan is successful. Permanent deed restrictions will be
required over the mitigation azea.

Clean Water Act Section 402
Under Section 402(P) of the Clean Water Act,the U.S. Environmental Protection
Agency is required to develop regulations for stormwater di:ccharges. The
Minnesota Pollution Control Agency (MPCA)has the authority to regulate the
stormwater program under the National Pollution Discharge Elimination System
(NPDES)program. The MPCA has written a general permit for construction sites,
which grade more than 1 acre. As of July 1, 2003, a permit application and fee of
$400 (no plans or specifications)must be sent to the MPCA at least 48 hours prior
to commencement of land disturbance activities. The permit application required
the site owner and contractor to certify the provision of the general permit,
including developing and implementing temporary and permanent erosion and
sediment control plans,will be followed. The general permit requires that
stormwater dischazges be preponded before dischazge to waters of the state
(including wetlands). The general permit also requires inspection and
maintenance of the erosion and sediment control facilities on a weekly basis. If
site grading exceeds one-acre,this permit will have to be obtained from the
MPCA.

B. Site Prepar�tion:
1. In areas with actively growing vegetation apply Raundup Originalmax�herbicide
per manufacturer's directions. Allow a minimum of 10 days before disturbing the
vegetati.on with other procedures.
2. Burn offthe dead vegetation by implementing a controlled bum using appropriate
procedures,equipment and permits.
3. Respray with Roundup Originalmax�herbicide if regrowth of vegetation occurs
when it reaches appmximately 10" to 12" in height.

Agreement for Removal or Retention of Conforming Accessory Structures

THIS AGREEMENT,made and entered into this � day of�+�Pisi,
2008,by Timothy Pellizzer,a single person,(hereinafter referred to as "Applicant")and the City of
Orono, a Minnesota municipal corporation(hereinafter referred to as the "City").
WITNESSETH:
WHEREAS, Applicant has made application to the City for demolition of the
principal residence structure on the properiy located at 520 North Arm Drive within the City of
Orono, Hennepin County, State of Minnesota, such property legally described as: Lot 3 block 1
Victoria Estates (hereinafter referred to as "Subject Property"); and
WHEREAS,the Applicant is the owner of the Subject Property; and
WHEREAS, the Subject Property contains a principal residence structure and a
conforming accessory structure shown on the survey or site plan attached hereto as Exhibit A and
WHEREAS, Applicant is aware that according to Orono Municipal Zoning Code
Section 78-1432, once the principal structure has been removed the conforming accessory
structure(s)will no longer be conforming,as they will no longer be accessory to an existing principal
structure; and
WHEREAS,the ordinances of the City require removal of all accessory structures at
the time of removal of the principal structure, because such accessory structures may become a
public nuisance due to lack of on-site property control and management; and
WHEREAS, the Applicant intends to, upon demolition of the principal structure,
immediately replace the principal structure on the site with a new principal structure in a location
such that the existing accessory structure(s)will remain conforming.
WHEREAS, the City intends to allow the accessory structure(s) to remain on the
Subject Property during construction of the new principal residence structure with the expectation
that said accessory structure(s) will again become conforming as soon as construction of the new
principal residence is completed.
NOW, THEREFORE, THE PARTIES TO THIS AGREEMENT AGREE TO THE
FOLLOWING:
1. Applicant may retain the existing accessory structure(s),subject to the following conditions:
A) Applicant agrees to obtain a building permit for construction of the replacement
residence within 60 days of demolition;to begin construction on the new residence

within 120 days of demolition; and to complete all exterior work within 1 year of
building permit issuance and interior work within 2 years of building permit issuance.
B) In the event that any activity described in item A has not been accomplished within
the defined timeframe, the Applicant shall remove the accessory structure at the
Applicants' expense.
C) If one of the item A events occurs and the Applicant fails to perform his removal
obligations per item B, the Applicant hereby agrees as follows:
1. The City may enter upon the property and remove the accessory structure(s).
2. The City may assess the costs of removal to the property.
3. This Agreement shall be binding upon current and future owners of Subject Property, and
shall be filed within the chain of title of the Subject Property.
5. Applicant shall indemnify and hold harmless the City, the City Council, and the agents and
employees of the City from and against all claims, damages, losses or expenses, including
attorney fees,which the City, City Council and agents and employees of the City may suffer
or for which it may be held liable, arising out of or resulting from the assertion against them
of any claims, debts or obligations in consequence of the performance of the terms of this
agreement.
