Sec. 78-1601 of Orono's Wetland Protection Ordinance, the proposed construction on the above listed property triggers the city's ordinance due to the following: • Disturbed property drains towards the wetland. • �rading exceeds 50 cubic yards. • Net increase in the square footage of impervious surface area. The wetlands found on this property have both been classified as Manage 3 wetlands, which require a buffer width of 16.5 feet. The following is a summary of the issues that exist with the current plan submitted to the City, and the requirements per the Wetland Protection Ordinance to be in compliance: 1. According to the current grading plan, the patio surrounding the pool is located in the setback. City ordinance states that all principle and accessory buildings must be set back a minimum of 20 feet from the wetland buffer(Div. 5 Sec. 78-1608 (2)). Patio slabs and grade-level decks are exempt from this rule which suggests the pool area may still be in compliance with the city's ordinance. 2. The patio surrounding the pool area will slope towards the wetland, and the reshaping of existing contours on the east side of the home may channel surface runoff towards the wetland and buffer (which lacks a complete setback area due to the patio). • Per Div. 5 Sec 78-1608 (1� hard surface runoff must be treated in accordance with the requirements of the city and appropriate watershed district. • Recommendation: Extend native buffer vegetation to proposed contour line (968', NE of pool) to filter runoff from patio, and east side of the home. Grading plan proposes reshaping of contour lines found within the buffer area, which will disrupt buffer vegetation (applies to both wetlands on the property). • A landscaping/seeding plan must be submitted outlining plans for restoration of the disturbed portion of the buffer. Seeding plan must include 12 PLS Ibs/ac of native grasses and 5 PLS Ibs/ac of native forbs containing four and five species respectively. • An escrow may be required to ensure buffer vegetation is properly installed and maintained. 4. The buffer area should be protected during construction by a silt fence (applies to both wetlands on the property). • The current plan shows the silt fence being installed within the buffer area; however it should be placed outside of the buffer(offering protection to both the wetland and the buffer, Div. 3 Sec: 78-1605, (3h)). 5. Unacceptable buffer areas. • Much of the understory vegetation found in the wooded portion of the wetland buffer(north of the house) is dominated by the undesirable plant species, common buckthorn. Per Div. 3 Sec. 78-1605 2 this is unacceptable buffer vegetation and should be removed and replaced with native vegetation. Removal of the buckthorn may help establishment of a better ground cover that will enhance the treatment and wildlife habitat the buffer provides. The seeding plan must include the list of species that will be used on site. Without the list of species, we are unable to confirm that the construction plan meets the requirements of the City of Orono's wetland buffer ordinance. To speed things along, I have designed a seeding mix (see attached excel worksheet) for the property that meets the requirements of the City's ordinance. If a seeding mix has not yet been prepared for the site, you may send us a letter stating that the property owner has agreed to use the seeding mix that Bonestroo designed. Also before we can approve the construction plan, we must receive confirmation that the property owner will agree to remove the buckthorn that currently exists in the wetland buffer north of the newly constructed home. Buckthorn must be removed by hand, with no heavy machinery as stated in a previous memo. Please send us written confirmation that the seeding plan designed by Bonestroo will be used to restore the disturbed portion of the wetland buffer (or send us a copy of the prepared seeding plan), as well as confirmation that existing buckthorn will be removed by hand.
