On November 6,2Q12 the City received a bullding permit applicatfon for a pool. Your application is incomplete.
The following items must be submitted or revised in order for your application to be considered complete and
for the plan review to continue:
1. Wetland Delineation. A Manage 2 wetland exists on the subject property; according to Orono's City ;
Code Chapter 78 Article XI Wetlands Protection, Manage 2 wetlands require a 25 foot wide vegetative
buffer. The proposed project appears to trigger the City's Wetlands Protection regulations. The
delineated edge, approved by the MCWD on December 30, 2011 must be shown on the survey, along
with the required 25'foot buffer and 20'structure setback from the buffer. The previous projects have
not triggered the buffer requirement.
2. Certiflcate of Survay. Please provide 2 copies of an updated, full size certificate of survey which meets
all of the City's survey standards (enclosed) indicating the location of the proposed pool (and any
proposed grading) as well as all existing buildin�s, structures, landscaping, retaining walis and hardcover
on the property. The survey must also show the approved wetland delineation,25'wetland buffer and
20'structure setback.The bufFer and setback should be staked on the site.
3. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The City cucrently holds and escrow fo�the building �
additions on the property. Please sign the updated escrow agreement combining the building and pool
permits. No additianal money is needed at this time.
4. Wetland Escrow&Fscrow Agreement. Projects which trlgger installation of a wetland buffer require a
wetland buffer improvement plan and an escrow (refer to attached City Code Section 78-1601(c)(4)). ,
After the delineated wetland edge, wetland buffer and structure setback are shown on the survey and
marked on the property,our wetland specialist will visit the site and determine what type of vegetative
" buffer improvements, if any, need to occur. If estabiishing a wetland buffer is requtred, the wetland
specialist with determine the cast associated with the buffer work and we will require that amount in
escrow until the buffer is established.

Sec.78-1601.-Purpose and Iriter�t.
(a) The purpose of this section is to recognize, preserve and protect the environmental, aesthetic and
hydrologic functions of the city's wetlands by regulating the use of wetiands and their adjacent properties in
conJunctlon with the goals of the environmental protectlon plan within the cornmunity management plan.
These functions include, but are not lim'ded to, sediment control, pollution control, fittration, �sh and wfldtife
habitat and aquifer recharge. The surfacc� water management plan wlll provide guidance for atortnwater
tr�tment requirements and wetland restoretion opportuni�es in order to protect the integrity of wetlands.
(b) The intent of this section is to protect we�ands to the maximum extent possible while allowing a reasonable
use of the property, This section adopts the regulations and standaMs of the WeUand Conservation Act of
1991 (WCA), Laws of Minnesota 1991; chapter 354, as amended, and the rules adopted pursuant to the
WCA. It also establishes a we�and oveMay distric� This overlay district further regulates the underlying land
use as allowed by other districts or the WCA.
(c) This ar�de applies to, and wetland buffer areas must be created or existing buffer areas must�maintained
around, a protected wetland loc�ted partially within, wholly within, or directly adjacent to the property in the
following situaUons:
{1) When the we�and is required to be rep{aced or restored,or when the wetland is being altered; ;
(2) When new development oa:urs. For purposes af this subsec�on, new development means:
a. Any subdivision that craates a new lot�at has no principal structure on it;
b. Constructlon of a prindpal structure on an existing vacant parcel of land;
(3) When tedevelopment occurs that has the potential to adversely impact a weband. For purposes of this
subsection redevelopment means�e removal of the principaf structure to the extent of more than 50
percent of its maricet value and volume and rec�nstrucfion on the same property. This reyuirement
does not appy ff oonstructlon is the result of fess than 75 peroent of the building being damaged by an
[nvoluntary force, such as flre,wind,or vandalism;
(4) When any construc�on or land a�erabon activity �at does not falt within the meaning of
'redevelopmenY has the potential to adversely impact a we�and. •
For purposes of this se�tlon, "the poten�al bo adversely impact a wetland" exists when all of the
following three conditions exist
a. The portlon of the property disturbed by construction or Iand aiteration activity drains fio the
wetland; and
� b. The amount of grading exceeds 50 cubic yards or the constructlon activihr involves the �
disturbance of more than 5,000 square feet of area;and
c. The redevelopment activity results in a net Increase In the square footage of impervious surtaces
that drain to the we�and, or results in the relocatlon of impervlous surfaces doser to the we�and,
or resufts In changes to drainage patterns (slopes, meander pattems, etc) that �e city engineer
determines will increase the velocity or rate of n.�noff to the wetland.
For new development, alf wetiands on the property shall be subJect to the buffer requlrements. For
redevelopment or other grading or construction sltuations that are not new development, only the
we�and that is potendally adversely impacted shall be subject to the buffer requirement In the event
that the wetland is on an adjaoent property but near enough to the subject property so that buffers to
said we�and would extend irrto the subject property,the buffer requirements apply.

Dear Christine:
As requested, we have reviewed the buffer area at 2900 Deer Run Trail. We offer the following observations,
comments and recommendations for your consideration.
1. I reviewed the wetland boundary and buffer in the field on November 13, 2012 and agree with the
wetland boundary and buffer area as marked.
2. The proposed construction has the potential to adversely impact the wetland which will trigger the
wetland protection ordinance requirements. Therefore, the following should be considered:
a. The west wetland is listed as a"Manage 2" wetland management class and the north wetland
is listed as a``Manage 3" wetland management class in the MCWD's Functional Assessment
of Wetlands inventory. A Manage 2 class requires a 25 foot buffer per City code and a
Manage 3 requires a 15 foot buffer. The applicant is proposing a 25 foot buffer around all
wetlands.
b. The existing buffer area is an open wooded area predominated by Red Maples, with very little,
if any undergrowth. A small percentage of reed canary grass, buckthorn and Canada thistle
was observed inside portions of the buffer area. It is our recommendation that the applicant
provide a vegetation plan which includes removal of the noxious and undesirable vegetation.
c. Wetland Buffer markers should be placed at the upland boundary of the buffer edge located at
lot lines and spaced a maximum 200 feet apart.
d. A $2000 escrow should be submitted by the Owner to cover the cost of buffer establishment
and management if not completed by the applicant.

The property addressed 2900 Deer Run Trail has submitted an application to install an in-ground pool. The
pool project triggers our wetland buffer requirements. I have attached a partial copy of the survey and the
MCWD notice of application and notice of decision.
