HomeMy WebLinkAboutrelease of interest RELEASE OF INTEREST THIS RELEASE is made this� 'day of _ , 1999,by the City of Orono, a municipal corporation under the laws of the State of Minnesota("City"). WHEREAS, C. Steven Wilson and Susan D. Wilson,husband and wife ("Wilson"), aze the fee owners of property located in the County of Hennepin, State of Minnesota, legally described as Lot 5, Block 1, ABINGDON GLEN ("Property"); WHEREAS, the Property is subject to that certain Declaration of Private Road Easement and Declaration of Covenants recorded February 10, 1984, as Document No. 1562404 in the office of the Hennepin County Registrar of Titles ("Declazation"); WHEREAS, the Declaration provides that, in the event the City is required to maintain the private road described in said Declaration("Private Road"), the City has the right to place a lien on the Property for a proportionate share of the cost of said maintenance; WHEREAS, Wilson applied to the City of Orono for subdivision of the Property into the following Parcels: That part of Lot 5, Block 1,ABINGDON GLEN, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for Hennepin County, Minnesota, that lies west of the east 60.00 feet thereof("Parcel 1"); and The East 60 feet of Lot 5,Block 1, ABINGDON GLEN, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for Hennepin County, Minnesota("Parcel 2"); WHEREAS, Wilson desires that Parcel2 be released from the terms and conditions of the Declaration, including the City's rights to lien thereunder; and WHEREAS, in its Resolution No. 4329 on file in the office of the Hennepin County Registrar of Titles, the City has consented to amendment of the Declaration to release Parcel2 from the terms and conditions of the Declazation. NOW THEREFORE,it is agreed as follows: 1. The City hereby releases Parcel2 from any rights it was granted in the Declaration, including the right to lien for the proportionate cost of maintenance of the Private Road. 2. The City agrees that its right to lien a proportionate share of the cost of maintenance of the Private Road as described in the Declaration shall run with and continue to burden Parcel 1, as it relates to the Property.
