During the review it was noted a retaining wall has been constructed within a required 35' wetland buffer and within the City's Drainage and Utility Easement. This structure is not allowed and must be removed. Once the retaining wall is removed, please work with the Minnehaha Creek Watershed District staff (MCWD) to restore the wetland buffer with native vegetation. Also noted on the as-built survey are wetland marker signs. These signs are incoRectly located on the wetland setback edge and must be moved to the correct location at the edge of the 35' wetland buffer. If you have any questions regarding the wetland buffer restoration and/or wetland buffer signs, contact the MCWD directly at 952-471-0590. Also, a Temporary Certificate of Occupancy was issued on January 14, 2014 with a completion date of June 15, 2014. We will continue to hold the $10,000 escrow until the above issues are resolved. During the initial site inspection, we observed two silt fences within the backyard of this site. The District had previously confirmed with the contractor that no silt fence was to be placed within the buffer, which was all included area from the edge of the delineated wetland measured out 25'. Establishing this understanding with the contractor led us to assume that the silt fence furthest from the finished home represented the initial boundary to the buffer. However, after measuring out the current location of the retaining wall on September 8th, it appears that the structure had been placed approximately 10' into what is considered the buffer area. Either the silt fence we observed did not accurately represent the extent of the construction on the parcel or the silt fence was installed in the wrong location after District directive on location. We apologize for any confusion on our part, and we are working with the homeowner and the applicant to rectify the situation. Following are my comments for your consideration: 1. A retaining wall on the southwest side of the property was constructed within a Drainage and Utility easement. An encroachment agreement should be submitted for this wall. 2. A retaining wall on the west side of the house is over 4' in height. Walls 4' or greater in height should be designed by a Professional Engineer, and plans submitted for review and approval. Verification from a licensed Professional Engineer should be submitted stating the wall was constructed per industry standards and the design meets required factor of safety margins. i If you have any questions or comments, please contact me to discuss.
