the bemefit of tho owners of the Property and the Disizict;and

Attachment A,wi�l be maiatained by Declarant in perpetuity free from mowing or other
veg�tative disturbance,fertilizer application, yard or oth�r waste disposai,tite ptacement
of structures or any other alteration t[zat impedos the function of the buffer in protecEing
the quality af water in the wetland or buffering flows into the wetland.
2. Street Sw�eeping.All streets and public ways within the Property will be

STORMWATER FACILI'�MAINTENANCE
These te�s apply ta the stormwater facilitics canstn�cted pur5uant to Minnehaha
Creek Watershcd District permit application ccumber Ob-04b.
VYHEREAS,�pplication has been rnade for a pecmit from the MCWD pursuant
to MCWD Rule N, Stormwater Mana�ement;and
�
WH�R�AS,the property that is the subject of the permit is lega[ly described in �
the Declaration in#a which this Atta.chment is incorporated,s.�d�th�facilities on the I
property to which these m�intenance requirements apply arc as follows: �

W��AS,MCWD Rule N provides that a maintenancE agreement shall be
subtnittcd for starmwater treahnent ponds,outlet stYuctures for such ponds,culverts,
outfall structures and�11 other stormwater f�cilities,and thst the maintenance agreement
shall specify methods,schedule and zesponsible partias for mai�tenance attd must include
at&minitnum, the elements comained in tbe District's Maintenance Agreement Form.
1�TOW,TH�REFORE:
1. The property owncr shall inspect the stormwater retention and treatment
basin{s)at a minimum of once a year to deternune if the basin's ratention and treaiment
characteristir,s 2�r�ade�uate. A storaga treatrnent basin will be considered inad�uate if
sediment has d�ereased the wet storage volwne by�of its original design volume,
Based oA this inspectioa,xf the st4rrnwater basin(s)is identified for sediment cle,araout,
the property owner si�al] restore the basin(s)to its origi�ai deszgca contours within one
year oPthe inspectian date,
2. The property ovv�aer shall inspect the grit chambers, sump eateh basins,
sump ma�nholes,outlet structures,culverts, outfall struetures or other starmwater facilities
�or the project in the spring and fa11 of each year. The property owner shail refftove a11
se�dimenfi and debris during the inspections such that the stor�nwat�ar fa�il�ties operate as
designed and permitted.
3. l�.ain gardens must be kept clean of excess sedifn�nt and debris.Hea]thy
plant�rowth must be�naintained in the rnin gardens by removing dead vegetation in the
spring of each year.
4. Violation of the inspection and/or maintenance provisions of tius
Agreemern is a viol,atian of the MCWD permit for the project for which the MCWD may
take action against the groperty awner.
