upon a Lot vcrithout the Architectuxal Control Committee's prior,w7r�itten a�ro'val of{a)the�lans
and specificatioxas for said I�mprovements,sncluding site locat�iion thereo�, and(b)t�e contractor

Sec�ion 2. Sub�nission o�In ation. Before constructioz� of any Improveme�ts is

the Homeowne�s Associatirnz two(2) complcte sets of arahitectural plans and speaificatzons for
the proposed Ymcprovements(iacludiag,w�ithout limit�ian,full site plaziss, elevations, floor plans,
extez�ior materia,�s, exterior colors, drivewa�plan, and laudsca�e pla�)alan�witXt the name,
,address and telephone number of the caz��ractor who will actua,lly pezform the proposed work and
the n�me, address and telephone number of the Owne�r. Upon request by the Cozximittee, a,n
Owner sha1I subaYit such additional informati,on as sha�.l reasonably be requested by fhe
Committee to e'vidence cox�pliance wit�the requirements of this article.
Section 3. Rev"ew Pexiod. Withxn twenty (20} days of its receipt of ai1 of the
docu�ents to be submitted undex Scction 2 of this Article,the Committee shall eitt�er approve oz�
disa�prove the plans ancl specificatio�ns for filie pzoposed Improve3oaents and tl�e coniractor who

ctued to obtain approval. Such notice shall be deezued to bE properly giver�if personally delivered

Section 7.Owne�r's R�medv. In the event that the Com�ittee shall fail to disci�arge its
obliga�iox�s under Arti.c�e III of this Declaratioxi,then any pwnez�of a Lot ma.y bring a;a a�ction to
compel the disclaarge of said obIigations. Such an act�on shall.be the exclusive remedy of any
Ov�mer far failure of the Committee to dischazge such pb�zgations and.�either the Committee nor

chazact�ni,stics only and sba1X not asseart architectural or eugineerin.g expartise in its z�eeview of
plans and specifications.In t�e course of its d�ties,the Committee��request certain desigr�
modifications in tb�e interest of producing ovexa.11 Iinprov�zuents more complementazy to or
compatible rwi.th the Real Propexty and ot�er Impravements thereon.It is the duty and
respo�sihility solely of each Owner to em.play an architecf or other qualified person#o design tbe
Dwellin�Unit and any�Znprovements and at�y requested modificatiozis in a safe and
architecturally sound manner.Each Owner of any iaterest in a Lot,and such Owner°s heirs,
successars a�d assigns�uvaives a�ty ri�ht to claim dam�ges from the Committee,its me�onbcrs,or
