It has come to our attenrion that Patrick Wa1sh, of 1390 Rest Point Road, has chosen to install a
fence which is in clear violation of the 0-75' and the average lakeshore setback ordinances.
Please see Photo 1 below wluch depicts the actual location of the fence (we have provided the
photos since we know that Mr Oman has had 2 knee replacements and does not need ta be
n�nning around, traipsing through peoples properties to take photos of actual code violations).
It can also be seen that Mr Walsh has failed to put the "finished side towards his neighbor's
property for a large portion of the fence as seen in Photo 2. Orono's fence ordinance requires
that the finished side is put towards the neighbor's yard:
"Materials and Maintenance
Fences must be installed with the finished side facing neighboring properties or the street.The term
"finished side"means that side having no structural supports"
We could not find anywhere in the code where it states that a person does not have to put a
fuushed side towards the neighbor's property if it is near an e�cisting structure. Furthermore,
dangerous nails can be seen protiuding into the neighbors yard from the fence. We do not see
how the neighbors could possibly maintain their house on that side without suffering
potentially serious injuries.
It also appears that the new deck Mr Walsh installed (was there a permit pulled for this deck as
required by Orono code? Will there be an after the fact permit fee if none was pulled as
required by Orono code?) has increased his hardcover on his already m�imized properry. As
we all know, any increase in hardcover in the 0-75' setback area, no matter how trivial, is
severely frowned upon by the City of Orono.
