Nyga rd, On June 25, 2012 a Stop Work order was issued by the Building Official for the construction/erection of a wind generator within the lake yard of your property at 1386 Rest Point Road. On or about lune 27, 2012 a second pole was erected in the lake yard of your property;a second Stop Work order was issued. Wind generators are not listed as permitted,accessory or conditional uses within the City and more specifically within the LR-1B lakeshore residential district where your property is located. As a result wind generators are prohibited. The wind generator and the poles must be removed from the property. Additionally,the concrete footings must also be removed as they constitute illegal hardcover within the 0 to 75'lakeshore setback zone. This letter will serve as your notice that you must cease and desist with all construction activity on your property not covered by an active building permit. Further this letter serves as your notice that the wind generator, poles and concrete footings must be removed from the property before Monday, July 9,2012 in order to avoid legal action by the City. Your property will be monitored and will be reinspected for compliance on or about July 9,2012. Please be advised, if you fail to correctthe violations this matter may be sent to the City Attorney for criminal prosecution or civil enforcement. I conducted a scheduled inspection with Mr. Nygard a little after 9:OOam today. There was two empty compost containers on the area next to the shed were the footing for the wind generator was. Mr. Nygard would not let me move the empty containers so I probed in on the west side of the container about 36" out from the shed. I was able to push my probe down approximately 30" and the soils seemed tight so it would not go down any further. I probed between the containers about 20" out from the shed and hit something solid at about 18" down. Mr. Nygard stated that he did not use clean fill when and that it must be a rock. Mr. Nygard would not let me to any more probing of the area. I took a picture of the compost containers and what appeared to be the anchor bolts, sawed off of the footing for the tower that had been removed. I was also presented a receipt for a 'Bagster Dumpste�in a Bag' that had been picked by Waste Management on September 1, 2015. It is my belief that the concrete footing for the tower has not been removed. From my experience as a certified Building Official and a certified Septic Inspector for more than 10 years and using a probe as part of my daily routines when doing septic inspections the solid object that I hit when doing my second probe was concrete. There was immediate contact upon pushing the probe with the weight of my body and it very felt solid. I also believe that the concrete footing is still in place because of Mr. Nygard's lack of cooperation to do a simple task of probing the soils underneath the empty containers. I also explained that I needed to do more probing of the area for me to feel that I had done an adequate investigation of the area so I could relay to the City Attorney the issue was resolved. I asked him if he would remove the empry containers multiple times explaining that I needed to do this to feel comfortable with being able to say that the concrete had been removed. He refused all of my requests to do a better job of exploration. Based on my 14 years of experience inspecting and the lack of cooperation on Mr. Nygard's part I do believe that the concrete is still in place.
