Sec. 78-1687 —78-1699. Reserved. DIVISION 3. REGULATIONS BASED ON ASSIGNED PROTECTION TIER AND UNDERLYING ZONING Sec. 78-1700. Suecific Tier Reaulations. Per the official Stormwater Oualitv Overlav District Man. each nrovertv in the stormwater aualitv nrotection overlav district is assi�ned to a nrotection tier based on its relative distance to receivin�waters. This brotection tier dictates the snecific t�rotection measures that must be imnlemented. (1) Tier 1 Parcels Hardcover shall not exceed twentv-five (251 nercent of the Qross lot area. (2) Tier 2 Parcels Hardcover shall not exceed thirtv (301 nercent of the Qross lot area. (3) Tier 3 Parcels Hardcover shall not exceed thirtv-five (351 nercent of the �ross lot area. (4) Tier 4 Parcels Hardcover shall not exceed fiftv(501 nercent of the Qross lot area. (5) Tier 5 Parcels Hardcover shall not exceed eiahtv-five (851 nercent of the aross lot area. Sec. 78-1701. Tier Assianment Methodoloav The inclusion of narcels into the Stormwater Oualitv Overlav District is based on the followin�methodolo�v. (1) Examine each tiarcel and determine whether or not it abuts a nrotected lakeshore or stream. a. All arcels that abut a protected lakeshore or stream shall be nlaced into Protection Tier 1. . - . b. All parcels that do not abut a protected lakeshore or stream shall be examined under the criteria in section 78-1701(21 below. (2) Determine the location of the primarv buildina area on the narcel bein� examined. The primarv buildin� area shall be identified bv the location of an e�istin� primarv structure (if applicablel, or bv considerina reauired setbacks and/or the averaQe location of structures on adiacent lots. a. If the nrimarv buildina area is whollv within �50' of a protected lakeshore or stream. the parcel shall be placed into Protection Tier l. b. If the vrimarv buildina area is whollv NOT within 250' of a nrotected lakeshore or stream the parcel shall continue to be examined under the criteria in section 78-1701(31 below. c. If the primarv buildina area is divided bv the 2�0' delineation line, the followina assessment shall �uide the desiQnation: i. If an adiacent parcel abuttins bv a side lot_line is alreadv assi�ned to Protection Tier 1, the parcel shall be nlaced into Protection Tier 1. ii. If all adiacent parcels abuttin�bv a side_lot line have not been assiQned to a protection tier the narcel shall continue to be examined under the criteria in section 78-1701(31 below. (3) Usin�the location of the primarv buildin� area as identified in section 78- 1701(21 determine the distance between the primarv buildin� area and the nearest nrotected lake or stream. Distances shall be measured from the reauired setback nearest the protected water bodv to the OHWL. a. If anv portion of the primarv buildinQ area is at a distance of 300' or less from a nrotected stream or is at all touchin�the landward extent of floodnlain from a stream the narcel shall be nlaced into Protection Tier 2. b. If anv t�ortion of the t�rimarv buildinQ area is at a distance between 250' and 500' from a t�rotected lakeshore, the parcel shall be nlaced into Protection Tier 2. c. If the primarv buildina area is at a distance areater than 500' and un to 1000' from a protected lakeshore. the parcel shall be placed into Protection Tier 3. d. If the t�rimarv buildina area is bevond a distance of 1000' from a nrotected lakeshore or stream the narcel shall continue to be e�amined under the criteria in section 78-1701(41 below. . . • , . . (4) Determine the zonin�of the subiect varcel. a. If the nronertv is zoned Residential Planned Unit Develotiment (RPUDI. the narcel shall be nlaced into Protection Tier 4. b. If the vronertv is zoned Industrial fIl, the narcel shall be nlaced into Protection Tier 5. c. If the narcel bein� examined has not vet been assianed to a Protection Zone. the narcel shall continue to be examined under the criteria in section 78-1701151 below. (5) Determine whether the unassi�ned varcel (or Qroun of unassi�ned narcelsl is within a gan. A Qan is an area of 20 acres or less that is lar�elv surrounded bv parcels assi�ned to nrotection tiers. Roadwavs, if nresen� will be used as a dividin�line when identifving �an areas. a. Beeinnin�with nazcels on an individual basis. if more than half of the border of a narcel is re�ulated via one of the nrotection tiers. the narcel shall be nlaced into the tier which abuts the narcel bv the �reatest erc� b. Unassi�ned narcel Qrounines of 20 acres or less that have more than half of the Qroun's overall border reQulated via one of the nrotection tiers shall be nlaced into the tier which abuts the aroun area bv the sreatest nercenta�e. c. Parcels still unassimed to a urotection tier followin�review under Section 78-1701(51(bl above shall be exemut from Stormwater Oualitv Overlav District re�ulations. As new narcels are created within the Citv as a result of subdivision. each new narcel shall be examined under this methodolo�v to determine whether it belon�s within a �rotection tier as nart of the overlav district. or be exemnt from the resulations of this Article.
