Carter 1310 Rest Point Lane Mound, MN 55364 Re: 1310 Rest Point Lane - Zoning Dear Mr. Carter: The above referenced property is zoned LR-1B Single Family Lakeshore Residential District,requiring a minimum lot size of 1.0 acres and 140' defined lot width. The property has an existing lot area of 0.439 acres per Hennepin County tax records. The defined width exceeds the 140'minimum. Principal � structure setback requirements are 35' from property lines abutting a street and 10' from the interior side lot line of this triangular property. The existing residence is less than 35' from the street lot lines based on the property survey on file at the City Offices. The lot is nonconforming, and the location of the residence structure within it is nonconforming. If the existing structure was destroyed, variances to lot area and street setbacks would be required in order to rebuild on the site within the same footprint. Based on the history of lot area variances for teardowns/rebuilds in the immediate neighborhood, it is likely that the City Council would grant a lot area variance,but it is less likely that setback variances would be granted. In my estimation, the property contains adequate area meeting the required setbacks that a conforming residence could be constructed on the site.
