The last few rains we have had have showed me that the grading for the silt wall is not perfect as water still comes onto my
property from the next door house.In fact this morning when we had the hard rain I had to go out and dig a ditch to re-divert
the stream that came from the next door house onto my property.
Also,when it has rained it causes a major river of mud through the next door houses back yard down the stairs down to the
lake. I am not sure what the DNR would think about that issue but it causes me concern.
Their insurance company has only delayed and delayed getting us an answer about our claim let alone and money to
reimburse us for the costs involved. We now are having to retain an attorney to deal with this matter and I believe the city has
some liability in this matter due to their inaction the city had with the problem with all of the correspondence we had with
you prior to this flooding event in my house.
This continues to be a huge problem and with the river of mud going down to the lake it may only get worse.
I look forward to yow response on your duty to protect the lake and the adjacent properties from the problems and
destruction that this development has caused and may continue to cause.

Denny.T'he survey shows that the power pole at the street is on the property line and there is a marker near your retaining

Why can't they get the property line staked?This is a fundamental issue of my properiy,and nobody seems to care. Why is
that?
I had to have a surveyor come out to survey my property line for my stairs and now he can just grade my property without
consequence. In the end how will you know if his grading is correct without knowing where the property line is? It is more
than 6°

I understand you gave them the permission to go ahead to continue working on the house,and lifted the stop work order.
I have stated this issue many times in the last 2 weeks,and the one(1)thing that still needs to be done is to have=2 Othe
surveyor come out and re-stake the property line as they are over into my property with their fence and their grading.Why
can't that seem to get done so they know whose property they are working on??
I am still not happy with the slope of the hill on our side yard by the back of the house. I would be curious to know what the
code is for a drop off and how steep it can be with the rise vs.run.
I am still working with their insurance company to re-finish my basement and the$20,000.00 in damage.No money has
changed hands as of yet.

The bob cat person just finished excavating around the 2 properties at 9:l Opm.It is hard to get babies asleep with that racket.
They are also grading on our p�operty up towards the street. Someone needs to tell them that they need to have the survey
people come out and re-stake e property line so the people who are doing the bobcat work will actually know where the
property line is. With all the m d that ran down into our yard it seems that they have lost track on where their property is.=2
OThe new silt fence is on our pFoperty for quite a while.
It is good to know from our cof�versation this afternoon that you are going to uphold the stop work order until they get the
grade correct for water run off,I and the back drop off fixed befare they will able to resume work.

Denny,I visited the site today and yes they did not follow the plan.I talked to Lane and he said they just wanted to get it
cleaned up but plan to work on the grading on Monday.He also called someone to do the silt fence and they should be there
today or tomorrow morning.He promised to clean up any mess that may occur before they get there. I asked how he intended
to deal with the elevation difference between your properties and he said he was going to work with you do drain your area

The 2 new housing construction projects next to us have a grading plan that was adopted at the city council meeting because
of the severe issues that draina,ge have upon my property and the neighbors to my North.My neighbors and myself spent a lot
of time with the city engineers'�and the city council meetings to make sure that the grading plan that was approved was ;safe
for the properties on either side of the housing construction project. Tonight I see what the builder has done for the grading
and it slopes entirely onto my property which risks my house being flooded,which is totally against what was approved by
the city council. This does not even address the 7 foot drop off that they have in my back yard that they have excavated right
up to my property line that is an accident waiting to happen for the kids and children in the neighborhood.
It is the city's responsibility,per their permitting process,to monitor these issues so we do not have a water catastrophe or a
physical injury to small children. I suggest that we have an immediate city official to come to the property to survey the
drainage issue and the severe drop off,and have the builder remedy any and all issues that they were to abide by from the
beginning of the permit process that was approved by the city council.This needs to be an immediate process that needs to be
in writing and transparent to all parties involved for the sake of the neighborhood and the integrity of the city official process.
Otherwise I foresee the city having a potential major liability in this issue which will not go away any time soon.
