Dear Christine,
Please see the revised survey which addresses Jesse's concerns around erosion control, grading,
contours, and the sanitary sewer. We also revised the Hardcover Calculation sheet which takes
into account the shed and the retaining walls. Regarding the Structural Coverage,the concrete
stoop will have a roof over it supported by posts and none of the decks are 6' above grade.
Lastly, a copy of the permit issued by the Minnehaha Creek Watershed District was issued
5/15/14. You should have received a copy in your email from Amanda Bednar.

1340 Rest Point Circle
On April 24, 2014 the City received an updated survey for 1340 Rest Point Circle. The following items must be
submitted or revised in order for your application to be considered complete and for the plan review to continue:
1. Certificate of Survey. A suroey dated 4-22-2014 was received and reviewed by City Engineer, Jesse Struve.
His comments are enclosed. Please have the surveyor updated the survey and submit two full-size, scalable
copies for our review.
2. Hardcover Calculations. Hardcover calculations were submitted, but appear to be missing the shed with in
75' of the lake and excluding retaining walls outside of 75' of the take. Attached is a copy of our hardcover
information packet. Please have the surveyor update the hardcover calculations and submit copies for our
review.
3. Structural Coverage. Residential lots that have a gross acreage of less than two acres shall comply with the
City's massing standards for strurtures. The total combined footprints of all principal and accessory
structures shall not exceed 15 percent of the gross lot area. All roofed structures more than six feet above
grade level and decks when partially or fully enclosed by fences, railings or walls which extend more than six
feet above grade level count toward lot coverage. Currently we don't have enough information to calculate
the structural coverage. Please clarify if the concrete stoop will have a roof over it with posts for support and
if any portion of the existing decks a,re 6 feet above grade or have railings.
Finally, we are waiting for a copy of the permit issued from the Minnehaha Creek Watershed District's (MCWD) or
documentation from the MCWD stating the'proposed project does not trigger any of their permitting requirements.

Melanie,
The survey submitted for the proposed house at 1340 Rest Point Cir and have the following concerns:
1. There should be some sort of erosion control plan in place to slow down the velocity of the water coming off the
driveway. Otherwise I foresee this being a continuous erosion issue.
2. Additional grading should be shown to the SE of the house to reflect a swale being maintained down the hill a
short distance and directing water toward the middle of the lot.
3. There appears to be an existing retaining wall along the NE corner of the property. The proposed grading just
East of this wall exceeds the minimum 3:1 requirement(shown at steeper than 2:1). This would not be allowed
because it would be too steep to feasibly maintain it. This slope should be reduced to a minimum of 3:1.
4. The survey should include contours extending into the neighboring properties so I can evaluate the proposed
grading between the houses and how the water flows.
5. The driveway is shown to be at a 20%grade heading down the hill. While the City does not have a maximum
slope standard it is standard practice to try to not exceed 10%. I would encourage the homeowner to consider
installing a heated driveway otherwise winter navigation on the driveway may be problematic.
6. While the proposed project does not impact the sanitary sewer on the lake side,the survey should reflect a
sanitary sewer easement and location of the sanitary sewer.

On April 7, 2014 the City received a building permit applicatio s
incomplete. The following items must be submitted or revise� �
complete and for the plan review to continue:
1. Certificate of Survey. A copy of a survey dated 8-14-2013 was submitted, but it does not show the
proposed project. Please provide two copies of an updated, full size certificate of survey which meets
�,�� all of the City's survey standards (endosed) indicating the location of the proposed additions and
removals (and any proposed grading). The survey must be a signed original and not a photo copy.
2. Hardcover Cafculations. The property is located in Tier 1 of the Stormwater Quality Overlay District. A
� copy of the existing hardcover calculations were submitted. Please have the surveyor prepare
c G� hardcover calcutations, showing existing and proposed hardcover, using the City's hardcover calculation
Y" worksheets. Attached is a copy of our hardcover information packet.
3. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
��;� reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and

The survey submitted for the proposed house at 1340 Rest Point Cir and have the following concerns:
1. There should be some sort of erosion control plan in place to slow down the velocity of the water coming off the
driveway. Otherwise I foresee this being a continuous erosion issue.
2. Additional grading should be shown to the SE of the house to reflect a swale being maintained down the hill a
short distance and directing water toward the middle of the lot.
3. There appears to be an existing retaining wall along the NE corner of the property. The proposed grading just
East of this wall exceeds the minimum 3:1 requirement(shown at steeper than 2:1). This would not be allowed
because it would be too steep to feasibly maintain it. This slope should be reduced to a minimum of 3:1.
4. The survey should include contours extending into the neighboring properties so I can evaluate the proposed
grading between the houses and how the water flows.
5. The driveway is shown to be at a 20�o grade heading down the hill. While the City does not have a maximum
slope standard it is standard practice to try to not exceed 109�0. I would encourage the homeowner to consider
installing a heated driveway otherwise winter navigation on the driveway may be problematic.
6. While the proposed project does not impact the sanitary sewer on the lake side,the survey should reflect a
sanitary sewer easement and location of the sanitary sewer.

2. Hardcover Calculations. The property is located in Tier 1 of the Stormwater Quality Overlay District. A

�� this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and

BUILDING PERMIT ESCROW AGREEMENT

AGREEMENT made this�day of �'�.� , 20�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City")Zigmund P ret&Joni Peterson ("Owners").
Recitals
1. A demolition and building permit applications have been filed for demolition of a detached garage
and construction of an attached garage located at 1340 Rest Point Circle the ("Subject Property"), legally
described as Lot 9 and the southwesterly %z of Lot 8, Rest Point Park, Lake Minnetonka, Hennepin County
Minnesota including adjoining '/2 of vacated street which lies between northerly line of Lot 10 and the
southwesterly line of Lot 9 according to the duly recorded plat thereof.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with demolition permit # oZ0/N-Do35S and
building permit# �/�,/-Oo ��'�' if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCR0IM. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been cpmpleted and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
