Additionally City Code 78-123 provides additional parameters within which a variance may be granted as follows: 4. Economic considerations alone do not constitute practical difficulties. Economic considerations have not been a factor in the variance approvsl determinadon. 5. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. The board or the council may not permit as a variance any use that is not permitted under Orono City Code Chapter 78 for property in the zone where the affected person's land is located. Thts condition is not applicable, as the use for a singte family residential is a permitted use in the LR•1B District 7. The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property. The Council has determined t6at smalllots are a practical difficult, this lot is one of t6e few In the neighborhood that 6as frontage on three sides. 9. The granting of the proposed variance will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter. No evidence has been provided that suggests the variance will impair health, safety, and welfare. 12. The granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable difficulty. Based on the amount of hardcover and structural capacity, it appears the applicant has made an attempt to coordinate the project and the neighborhood. 4 Np CITY 4F ORONO RESOLUTION OF THE CITY COUNCIL y ; No. b 7 6 S 1kE5 H CONCLUSIONS, ORDER AND CONDITIONS: Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-330 to allow the three variances described above, subject to the following conditions: 1.
