Hello,
The property addressed 2730 Rainey Road is part of a subdivision created in 1988. The file does not include a copy of a
wetland delineation. Attached is a copy of the survey on file from when the house was proposed showing a drainage
easement. We deduce the easement was in alignment with the wetland at that time. Wetlands can change over the
years,so the exact edge of the wetland is unknown. Attached is a map showing the approximate wetland location.
The council considered changes to the wetland setback rules, but did not make any changes. A fire pit cannot be
constructed within the easement area and must be setback 35'from the edge of the wetland. There does not appear to
be a designated wetland buffer on this property. Also attached is a copy of the Flowage and Conservation Easement for
your reference.

i
My husband and I recently purchased a residential property in Orono and we will be moving there this
summer. We expect to make some landscaping changes and want to be sure we are in compliance with the
wetland buffer and setback requirements.
The residential property is:

I would like to request a delineation map so that we can be sure we're in compliance. From the city website, it
looks like this type of document exists already and doesn't have to be created from scratch for our request. If a
new survey is required in order to generate a map, let's discuss,because we aren't especially planning to make
any drastic changes. It is more that we want to be well-informed about existing restrict6ions.
I also have a few questions about the ordinances.
From the May 8th council meeting minutes, it looks like we would be required to have a 35 foot setback from
the wetland border,but the rules about a buffer are not clear to me within that. What amount of buffer is
required for a Class 3 wetland like ours? Is a buffer included in the 35 foot setback or is it in addition to the
setback?
We particularly want to construct a fire ring and it is not clear to me whether it is possible to do that within the
setback. It looks like it is not possible (or really even advisable)to construct one within the buffer, given the
wild nature of a buffer area.
If you could let me know what timing might be to receive the documentation and how it will be delivered,that
would be helpful. If it is something that's sent in the mail, I should give you our current address because we are
not yet living at the Orono house.

assigns, and successors hereinafter collectively referred to as the
Grantor(s) ] and the City of Orono, its successors and assigns, a municipal
corporation under the laws of the State of Minnesota (hereinafter referred
to as the Grantee).
WIT�I$SSBTH, Graritor(s), for and in consideration of the sum of
One Dollar (51,00) and other valuable consideration, hereby covenant, �
gzant, gift, quit claim and convey to grantee the right to restrict and
grantor( s ) agree to limit and preclude the use , improvement and
development, under the conditions and covenants herein contained, the
fol lowing described Land in the County of Hennepin and State of Minnesota:
over the drainage easements as shown on the plat of TREES TO BE
as follows:
1. Grantor(s) hereby covenant and agree(s) :
A. No structures shall be constructed, erected, or placed upon,
above, or beneath the Land including without limitation, fences,
fireplaces, steps, docks, piers, hardcover or roads of any nature
whatsoever, or any other structure or improvement inconsistent
with the natural state of the Land.
B. No trees, shrubs or other vegetation shall be destroyed, cut
or removed f rom the Land except as authorized by written consent
of Grantee.
C. No earth, loam, peat, gravel , soil or any other natural
material or substance shall be m�ved or removed from the Land and
there shall be no dredging or excavation of any nature whatsoever
or any change of the topography of the Land without the written
consent of Grantee.
- D. No soil , sand, gravel or other substance or material as
landfil 1 Bhal 1 be placed, dumped or stored upon the Land and no
waste, trash or garbage shall be placed, dumped or stored upon
the Land. •
E. No use shall be made of the Land except uses, if any, which
will not change or alter the natural condition of the Land, and
no use which would tend to change the drainage, f lood control ,
water conservakion, erosion control, soil conservation, fish and
wildlife habitat characteristics shall be made of the Land or the�
water situated thereon. � •
F. Grantee may enter upon the Land for the purposes o•f
inspection and enforcement of the covenants contained herein and
to cause to be removed from the Land without any liability any
structures, uses, materials, substances, or unnatural matter
- inconsistent with the covenants contained herein and the naturtsl
� state of the Land. '

2. Grantor(s) hereby grant, gift, quit claim and convey to Grantee, a
perpetual flowage easement and right and privilege to trespass with
water over and upon any or a 11 of the Land.
3. Grantor(s) herein do hereby remiss, release, acquit and forever
discharge, forever, the Grantee and any and all of its officers and
employees of and from any and all claims, demands or causes of action
: of any kind or nature whatsoever which may arise or accrue by virtue
of any flowage or trespass with water within terms of these agree-
ments.
In addition to any other remedy the Grantee may have, the
covenants and restrictions contained herein may be enforced by injunction.
Grantor(s) do not intend that the public should have any interest
in the above land by virtue of this indenture or otherwise, except as
her�inabove set forth.
The Grantor(s) herein certify that the land herein described are
free and clear of all encumbrances except: None
All provisions hereof shall run with the land and shall extend to
