A RESOLUTION GRANTII�TG A VARIANCE.
TO MUNICIPAL ZO�'G CODE
SECTION 10.55. SUBDIVISION 8
FILE NO. 2643
WHEREAS,Patrick M.Burton and Kirsten M.Burton,(hereinafter"the applicants")
are the owners of the property located at 2601 Rainey Road within the City of Orono (hereinafter
"the City") and legally described as follows:
Lot 3, Block 1, TREES TO BE and Outlot B TREES TO BE, CITY OF ORONO,
Hennepin County, Minnesota(hereinafter "the property"); and
WHEREAS, the applicants have applied to the City for a variance to Municipal
Zoning Code Section 10.55, Subdivision 8 to permit the construction of a private drive�vay through
a�vetland ��here no fill is normally allowed.
WHEREAS, after due published notice and mailed notice in accordance �vith
l��innesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Plarulin;
Cummission held a public hearing on November 20, 2000, at which time all persons desiring to be
heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as ZoninQ File #2643.
'�. The property is located in the RR-1B Zoninj District,�vhere 2 acres or 87,120 s.f. is
the minimum required lot area. The property consists of approximately 13.86 acres.
3. The Orono Planning Commission revie«-ed this application on November 20, 2000
and recommended approval by a vote of 6 to 0.
�. The Planning Commission made the following findings of fact:

A. The driveway at the north end of the property is the only feasible means of
access to the proposed building site.
B. Approval of wetland fill to allow for driveway access was not granted with
TREES TO BE subdivision in 1988.
C. The driveway crossing is proposed to be located where it will cause the least
disruption of wetlands.
�. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other properly in this zoning district; that granting
the variance will not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants,but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preser�-e a substantial property right of the applicants;
and �vould be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
6. The City Council has considered this application including the findings and
recommendations of the Planning Commission,reports by City Staff,comments by
the applicants and the effect of the nroposed variance on the health, safety and
welfare of the community.
CONCLUSIONS, ORDER,AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
�.�ariance to Municipal Zonin� Code Section 10.��. Subdivision 8 to permit the construction of a
� ' pri�✓ate driveway throuah a wetland where no fill is normally allowed. Approval is subject to the �
followin� conditions:
1. VVhen the conditions of the Minnehaha Creek Watershed District are met and a
permit is issued, the City will then issue a permit to construct the private drive�vay
through the «'etland.

2. Council approval is based on the site plan submitted by the applicants attached to this
resolution as Exhibit A. Any amendments to the site plan may require further
Planning Commission and City Council review.
;. Authorities granted by this variance run with the property not with the applicant�.
but are permissive only and must be exercised by application for a permit
within one year of the date of Council approval,or these variances will expire on tha;
date (November 27, 2001).
4. �+'iolation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code,shall automatically terminate
a�y authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned applicants have read,understood and hereby agrees to the terms ot
this resolution and on behalf of themselves, their heirs, successors and assign�.
hereby agrees to the recording of this resolution in the Chain of Title of the propem�.
