' • , , ���p CITY OF ORONO RESOLUTION OF THE CITY COUNCIL ��, G� NO. � 7 L � j�'FE3H��� A RESOLUTION APPROVING VARIANCES FROM MUNICIPAL ZONING CODE SECTION 78-420 FILE NO. 17-3889 WHEREAS, Timothy White and Jane White, a mamed couple (hereinafter the "Applicants"), ar� the owners of the property located at 2170 Prospect Avenue, and legally described as: T at part of the Northeast Quarter of the Southwest Quarter of Section 10, Townshi 117, Range 23 West, Hennepin County, Minnesota, described as COMME CING at a point 515.625 feet north of the south line and 208.00 feet east of the west'line of the Northeast Quarter of the Southwest Quarter of said Section 10; thence East 72.0 feet;thence North 130.0 feet;thence East 50.0 feet;thence North 58.3 feet;therMce West 122.0 feet;thence South 188.3 feet to the point of beginning;subject to street�hereinafter the"Propert�'); VIMHEREAS, on December 14, 2016, the Applicants made application to the City of Orono for variances to Orono Municipal Zoning Code Section 78-420 to allow an addition to the existing home 18 feet from the side street where a 50-foot setback is required, and 17.9 feet from the side lot line where a 30-foot setback is required; and V1�HEREAS, on January 17, 2017, after pubtished and mailed notice in accordance with Minnesota �tatutes and the City Code, the Planning Commission held a public hearing, at which time all persons desiring to be heard conceming this application were given the opportunity to speak thereon; and WHEREAS, on January 17, 2017, the Planning Commission recommended approval of the v�ariances; and V1�HEREAS, on February 13, 2017, the City Council reviewed the application and the recommendations of the Planning Commission and City staff; and NI�W,THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota hereby approve$ the requested variances as described above based on one or more of the following finding� of fact concerning the Property: 1 1 , ���p CITY OF ORONO RESOLUTION OF THE CITY COUNCIL � � ti NO. � 7 7 [ �' G l'9kESH��� FINDINGS OF FACT: 1. This application was reviewed as Zoning File #17-3889. The analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above mentioned meetings, and any and all other materials distributed at these meetings are hereby in�orporated by reference. 2. The Property is located in the RR-1 B Rural Residential Zoning District. 3. The Property contains 20,305 square feet(0.46 acre) in area and has a defined lot width of 45 feet. 4. The Prop�rty is within Tier 3 and hardcover is limited to 35% according to the Stormwater Quality Overlay District. 5. Applicant�has applied for the following variances: a. Side street setback variance. b. Side setback variance. 6. In consid�ring this application for variance, the Council has considered the advice and recomme�hdation of the Planning Commission and the effect of the proposed variance upon the ihealth, safety and welfare of the community, existing and anticipated traffic conditiong, light and air, danger of fire, risk to the public safety, and the effect on values of propefiy in the suRounding a�ea. ANALYSIS: 1. "Variance� shall only be permitted when they are in harmony with the general purposes and intent of the ordinance . . . ." The Applicants propose to construct an addition to the existing relsidence on a residential property which is in line with the intent of the ordinance. 2. "Variance$ shall only be permitted . . . when the variances are consistent with the comprehensive plan." The variances resulting in an addition to a single family residence in a residential zone are consistent with the Comprehensive Pfan. 3. "Variances may be granted when the applicant for the variance establishes that there are practical difficulties in complying with the zoning ordinance. `Practical difficulties,'as used in connection with the granting of a variance, means that: 2 ���p I CITY OF ORONO RESOLUTION OF THE CITY COUNCIL ��, � No. � 7 2 1 � l'�kES H p��' a. The property owner in question proposes to use the property in a reasonable manner, however, the proposed use is not permitted by the o�cial controls. The request to permit additions to the existing home within the 50 foot side street and 30 foot side setback areas appears to be reasonable as the adjacent prpperties do not appear to be adversely impacted; the encroachments will not extend closer to the road, front lot line, or the east property line than the existing home. b. The plight of the landowner is due to circumstances unique to his property not created by the landowner. The existing home and its orientation on the Property were not created by the Applicants; the existing home and neighboring homes are separated sufficiently to allOw for light, air, and open space befinreen the homes and the proposed addition. c. Th� variance, if granted, will not alter the essential character of the locality." Th� scale or setbacks of the proposed addition to the home will not alter the ch�racter of the neighborhood. 4. "Economic considerations alone do not constitute practical difficulties." Economic considera$ons have not been a factor in the variance approval determination. 5. "Practical dlifficulties also include but are not limited to inadequate access to direct sunlight for solar ehergy systems. Variances shall be granted for earth-sheltered construction as defined in Ntinn. Stat. § 216C.06, subd. 2, when in harmony with Orono City Code Chapter 78.°This cpndition is not applicable. 6. "The board or the council may not permit as a variance any use that is not permitted under Orono City� Code Chapter 78 for property in the zone where the affected person's land is located." This condition is not applicable, as a residence is an allowed use in the RR-1 B District. 7. "The boardl or council may permit as a variance the temporary use of a one-family dwelling as a finro-family dwelling."This condition is not applicable. 8. "The speci�l conditions applying to the structure or land in question are peculiar to such property or;immediately adjoining property."The nonconforming lot area and lot width of the Property a�re not uncommon in the surrounding neighborhood. The Applicants are proposing an addition to existing home in order to improve functionality. The existing substandartd setback to the side street and east lot line will not be increased with the proposed�ddition. 3 �-o� p I CITY OF ORONO RESOLUTION OF THE CITY COUNCIL ��, ��' No. � 7 2 1 G tqxES H��� 9. "The conditions do not apply generally to other land or structures in the district in which the land is loaated." The proposed home with the addition will be generally in line with the neighboriMg homes with respect to size and setback. 10. "The gran�ing of the application is necessary for the p�eservation and enjoyment of a substantial property right of the applicant." The Applicants have indicated that this criterion is met. 11. "The gran�ng of the proposed variance will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter." Granting the requested variances will not adversely impact health, safety, comfort, or morals; nor will it be contrary to the intent of the Code. 12. "The granting of such variance will not merely serve as a convenience to the applicant, but is necessary to alleviate demonstrable difficulty."The three street frontages, the substandard size and width of the Property combined with the 2-acre district setbacks create praCtical difficulties affecting the Property; the variances are necessary and not merely ser+ve as a convenience to the Applicants. , CONCLUSIONS. ORDER AND CONDITIONS: Based upqn one or more of the above findings, the Orono City Council hereby grants a variance to Oronoj Municipal Zoning Code Section 78-420 to allow construction of an addition to the existing home 118 feet from the side street where a 50-foot setback is required, and 17.9 feet from the side lot lirhe where a 30-foot setback is required, subject to the following conditions: 1. Council approval is based on the survey dated June 3, 2016 by Willis L. Gilliard and building pl�ns submitted by the Applicants and annotated by City staff, attached to this Resolution;as Exhibits A 8� B. Any amendments to the plans which are not in conformity with City codes may require further Ptanning Commission and City Council review. 2. The existing shed on the east side lot line of the Property shall be removed prior to the framing inspection for the addition. 3. Authorities granted by this resolution run with the Property not with the Applicants, but are permissive �only and must be exercised by obtaining a building permit for the new constructiorh and commencing construction of said project. A framing inspection must be completed writhin one year of the date of Council approval, or the variance will expire on that date (Flebruary 13, 2018). 4 I ���p CITY OF ORONO RESOLUTION OF THE CITY COUNCIL ��, Gti�C` NO. � / Z � jAkESH04� 4. Violation pf or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned Applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the Applicants and the Applicants' heirs, successors and assigns, l7ereby agree to the recording of this resolution in the chain of title of the Property.
