Roger Peitso <br /> City of Orono <br /> (952) 249-4625 <br /> Dear Roger: <br /> It was nice having a chance to visit with you on the phone in regard to the problems we have <br /> had with water flooding onto our property. The reason for this problem is that the landscaping <br /> company, Yardscapes, has not put in the swale 15 to 18 inches below the rock wall which they <br /> said they would construct. <br /> In the fall of 2013 the contractor, Sven Gustafson of Stonewood,John Sather of Yardscapes, <br /> Mrs. Gail Teynor who owns the property at 2789 Pheasant Road in Orono, Lyle Oman from the <br /> City of Orono and Lee Sundet met. <br /> Lyle asked the landscaper how they were going to solve the problem of the water and mud <br /> running onto the Sundet's property (2791 Pheasant Road). <br /> The landscaper said they would put up a rock wall and there would be a swale between the <br /> rock wall and the Teynor house so the water drains to the lake. <br /> Lyle said that would be acceptable. <br /> The rock wall was not completed until the fall of 2014. On October 2"d Mr. Oman brought Bob <br /> Bean and showed how they had not built the wall and the swale according to plan. Also Lyle <br /> Oman said he was there when he saw the water running onto Sundet's property and it was very <br /> evident the rock wall was not high enough and did not have the proper swale to drain the water <br /> toward the lake. <br /> Bob Bean wrote a letter dated October 10th confirming it had not been built to plan. <br /> On October 30th Lee Sundet wrote to John Sather of Yardscapes and asked how high the <br /> boulders would be above the swale. <br /> On November 3rd lohn Sather replied the swale would be 15 to 18 inches above the rock wall <br /> and also said they would install the swale. <br /> On November 18th John Sather wrote and said they had corrected the draining wall. <br /> When Lee Sundet returned in late May he went over and noticed there was no swale 15 to 18 <br /> inches as was promised in 2013 and as Mr. Oman and Mr. Bean requested. All Sundets are <br /> asking is for the swale to be at least 15 or more inches deep and wide enough along the wall so <br /> it can drain all the water to the lake. <br /> �. <br />
