The property is located in the LR — 1B zoning district, which requires a <br /> minimum lot size of 1 acre. The subject property is 0.75 acres. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on November 17, 2003 and recommended approval of the front yard <br /> setback variance based on the following findings: <br /> a. The nature of the existing 4/12 pitched roof causes snow loading <br /> problems, <br /> b. A new 7/12 pitched roof would allow snow to slide off the roof with <br /> greater ease, <br /> c. The steeper roof creates the need for a covered entry to minimize icy <br /> conditions and create a safer entrance. <br /> d. The existing front yard setback is non-conforming. <br /> e. The total right-of-way on Pheasant Road is excessive at 60 feet. <br /> f. There will be no negative visual impacts from the road. <br /> 4. The City Council has considered this application including the findings <br /> and recommendation of the Planning Commission, reports by City staff, <br /> comments by the applicants and the public, and the effect of the proposed <br /> variance on the health, safety and welfaze of the community. <br /> 5. The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variance would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to neighboring <br /> property; would not merely serve as a convenience to the applicants, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> Page2of5 <br />
