Per City Code Section 86-68, a foundation survey is required to be submitted <br /> prior to commencement of framing; and <br /> b. An as-built grading plan verifying compliance with the building permit, <br /> stormwater management, grading and drainage plans shall be submitted prior to <br /> the issuance of a Certificate of Occupancy for the residence. <br /> 4. With the issuance of the building permit for the new residence, the property address will <br /> be changed from 2655 Shadywood Road to 2600 Pheasant Road as the driveway is <br /> proposed to access off of Pheasant Road. <br /> 5. The applicants will grant to the City a drainage and utility easement over the existing <br /> drainage swale on their property. <br /> 6. The building plans submitted for building permit will be reviewed to ensure compliance <br /> with the City's building height and number of stories regulations. <br /> 7. Applicants shall remove and not replace all plastic or fabric liner material from the <br /> decorative landscape beds on the property to ensure their permeability as non-hardcover <br /> surfaces. <br /> 8. Required removals of structure and hardcover to be removed shall be completed prior to <br /> the footing inspection for the new residence. <br /> 9. Authorities granted by this resolution run with the property not with the applicants, but <br /> are permissive only and must be exercised by obtaining a building permit for the new <br /> construction within one year of the date of Council approval, or the variance will expire <br /> on that date (February 22, 2011). <br /> 10. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> 11. The undersigned applicants have read, understand and hereby a�ee to the terms of this <br /> resolution and on behalf of the applicants and the applicants' heirs, successors and <br /> assigns, hereby agree to the recording of this resolution in the chain of title of the <br /> property. <br /> Page 4 of 5 <br />
