The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 (A) and 2 to permit <br /> the construction of a 650 s.f. addition to the south side of the existing residence to be located <br /> , 39' from the channel shoreline and 50' from the Maxwell Bay shoreline resulting in a total <br /> hardcover of 5,066 s.f. or 11%, subject to the following conditions: � <br /> . • 1. All hardcover scheduled for removal must be completed prior to the final <br /> inspection for new construction by the Orono Building Inspector. <br /> 2. The area or footprint of the addition shall not exceed 650 s.f. of hardcover. <br /> Overhang on new addition shall not encroach further into approved 39' setback <br /> from channel shoreline, overhang along Maxwell Bay, shall be 2'/z' and at <br /> southwest corner shall encroach no further into approved 50' setback and <br /> overhang shall be 4' along the west side of the structure. <br /> 3. Authorities granted by this variance run with the property not with the applicants, <br /> but are permissive only and must be exercised by application for a building . <br /> permit within one year of the date of Council approval, or this variance will <br /> � expire on that date (March 14, 1995). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this � <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 5.
