This structure <br /> consists of illegal hardcover and structure within 75-feet of the ordinary high water level (OHWL) <br /> of Lake Minnetonka as well as within the average lakeshore setback area. After further <br /> research staff has confirmed that this structure did not appear on an October 28, 2002 survey <br /> (attached) of the property and subsequently no permits have been issued for this structure. <br /> . <br /> To summarize, this structure is considered an illegal structure and must be removed. The illegal <br /> - structure is in violation of the following City Code sections 78-1279(1) & (6) Placement of <br /> � Structures on Lots; 78-1288 Hardcover Limitations; and 86-66 Building Permit Required. <br /> Copies of these code sections are attached for your reference. <br /> This letter will serve as your notice that the property must be brought into compliance <br /> before Monday, December 20, 2010 in order to avoid legal action by the City. In order to <br /> bring your property into compliance the structure must be removed from the property before <br /> Monday, December 20,2010. The property will be inspected after this date to verify compliance <br /> with this notice. <br /> Please be advised, if you fail to correct the violations this matter will be sent to the City Attorney <br /> for consideration of legal action.
