'\ r <br /> Agreement for Removal of an Accessory Structure <br /> Right-of-Entry <br /> THIS AGREEMENT, made and entered into this �� day of , <br /> 2010, by Brent Teele and Amy Sullivan-Teele (hereinafter referred to as "Property Owners") <br /> and the City of Orono, a Minnesota municipal corporation(hereinafter referred to as the"City"). <br /> WITNESSETH: <br /> WHEREAS, the Properry Owners have an accessory structure that is located within the <br /> setback area and on their property located at 577 Park Lane, within the City of Orono, Hennepin <br /> County,Minnesota, (hereinafter refened to as the "Subject Property"); and <br /> WHEREAS,the Property Owners are the owners of the Subject Property; and <br /> WHEREAS, Property Owners are aware that according to Orono Municipal Zoning <br /> Code Section 78-1279, the setback requirement from the Ordinary High Water Level is seventy- <br /> five feet; and <br /> WHEREAS, the City intends to allow this accessory structure to remain on the properly <br /> until the beginning of the winter season, when the ice makes it reasonably safe to use the <br /> structure for its intended purpose, with the expecta.tion that the structure will not be returned to <br /> the required setback area at the end of the winter season; and <br /> WHEREAS, the Property Owners agree to a11ow City personnel to remove a11 personal <br /> items from the accessory structure and allow the City to demolish the accessory structure and <br /> remove the debris from the accessory structure if it is not moved from the required setback area <br /> at the beginning of the winter season, if the structure is placed within the required setback area at <br /> the end of the 2010-2011 winter season without receiving proper permits, or if the structure is <br /> within the required setback area after January 1, 2011. <br /> NOW, THEREFORE, THE PARTIES TO THIS AGREEMENT AGREE TO THE <br /> FOLLOWING: <br /> 1. The accessory structure may remain where it currently sits until the winter season, <br /> when the condition of the ice makes it reasonably safe to move the structure onto the ice for its <br /> intended purpose. <br /> 2. The accessory structure may not be placed within the seventy-five foot setback <br /> area at the end of the winter season if the Property Owners have not obtained proper permits to <br /> do so. <br /> 3. The City may enter the accessory structure and remove all of the Property <br /> Owners' personal property from the accessory structure and demolish the accessory structure <br /> after the personal property has been removed at the earliest of the following: <br /> is22�s�i 1 <br />
