A. the structure remains within the required shore setback area after <br /> reasonably safe conditions to move the structure onto the ice develop and <br /> the structure is not moved from the required setback area; or <br /> B. the structure is within the required setback area at the end of the winter <br /> season; or <br /> C. the structure is within the required setback area any later than January 1, <br /> 2011. <br /> 4. The Property Owners agree to deposit One Thousand and no/100ths Dollars <br /> ($1000.00) with the City which may be used by the City to secure the demolition of and removal <br /> of debris from the accessory structure. <br /> 5. The Property Owner shall hold harmless the City, the City Council, and its agents <br /> and employees of the City from and against all claims for damages that occur to the personal <br /> property during the move that was not caused by the City's negligence. <br /> 6. Applicant shall indemnify and hold harmless the City, the City Council, and the <br /> agents and employees of the City from and against all claims, damages, losses or expenses, <br /> including attorney fees, which the City, City Council and agents and employees of the City may <br /> suffer or for which it may be held liable, arising out of or resulting from the assertion against <br /> them of any claims, debts or obligations in consequence of the performance of the terms of this <br /> agreement. <br /> CITY OF ORONO: <br /> By: a?•wt-y--L'� .��2�� <br /> J mes M.
