The property is located in the LR-1B, Single Family Lakeshore <br /> Residential zoning district, which requires a minimum of 43,560 s.f. (1 <br /> acre) in lot area and 140' in width. The property is 9,440 square feet and <br /> 50' in width. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on February 19, 2008 and recommended approval of the hardcover <br /> variance and conditional use permit based on the following findings: <br /> a. City Code 78-1282 allows for the installation of sta.irs, lifts and <br /> landings in place of major topographic alterations on steep slopes. <br /> b. The proposed changes to the stair system and wall result in an increase <br /> in 0-75' zone hardcover frorn 4.8% to 8.8% but will be safer than the <br /> existing stairs. <br /> c. The existing railroad tie stairs and landings have a greater visual <br /> impact from the lake than the proposed stair system. <br /> d. The proposed walls will be 3' or less in height and screened from the <br /> lake by vegetation for a more natural looking slope. <br /> e. The applicants have provided a restoration plan meeting the goals and <br /> intent of the Zoning Code and the Orono Community Management <br /> Plan. <br /> 4. The City Council has considered this application including the findings <br /> and recommendation of the Planning Commission, reports by City staff, <br /> comments by the applicants and the public, and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 5. At the time of the building permit review the applicants presented a <br /> revised lake access stair design. On June 23, 2008, the City Council has <br /> considered the revised plans received by the City on June 12, 2008 and the <br /> survey submitted by the applicants as revised on June 12, 2008. <br /> 6. The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variance would not adversely affect traffic <br /> Page 2 of 5 <br />
