Ludington filed a <br /> petition with the City of Orono requesting the vacation of a portion of <br /> Forest Boulevard originally dedicated in the Plat of Saga Hill Revised <br /> legally described as follows: <br /> That part of vacated Forest Boulevard as dedicated in <br /> the plat of "Saqa Hill Revised, Hennepin County, <br /> Minnesota" which lies between the Northwesterly <br /> extensions across it of the Northeasterly line of Lot <br /> 9, Block 15, "Saga Hill Revised, Hennepin County, <br /> Minnesota " and the straight portion of the <br /> Southwesterly line of said Lot 9; and <br /> WHEREAS, after due published and posted notice, a public hearing <br /> was held before the City Planning Commission on March •21, 1988, regarding <br /> ' said vacation and all interested persons were given an opportunity to be <br /> heard; and <br /> � <br /> WHER$AS, af ter due standing and consideration, the Planning <br /> Commission recommended approval of the requested vacation and the Council <br /> of the City of Orono finds that said vacation as proposed, is in keeping <br /> with the public interest in consideration of the following findings: <br /> 1. The vacation does not affect the access or the use of adjoining <br /> properties. <br /> 2. The City has not and does not intend to develop, improve, or use <br /> the dedicated right-of-way ot Forest Boulevard for road purposes. <br /> 3. The City has not and does not intend to maintain or install <br /> utilities within the dedicated riqht-of-way of Forest Boulevard. <br /> 4.
