The dedication of roadway to the City creates a setback , <br /> hardship on the front line of the property. <br /> 6. The property has been assessed for single sewer unit and <br /> footage charge in the amount of $2,186.50. The $225 plant . <br /> unit charge remains to be paid.. � <br /> 7. The City Council has considered this application <br /> incl�:3ing the f indings and recommendations of the Planning <br /> • Commission, repo'rts by City staf f, comments by the applicant <br /> and the effect of the proposed yarianee on the health, safety <br /> and welfare of the community. . ' <br /> 8. The City Council finds that the conditions existing on <br /> this property are peculiar to it and do not apply generally to <br /> other property in this zoning district; that granting the <br /> ' variance would not adversely affect traffic' conditions, <br /> light, air nor pose a fire hazard or other danger to <br /> - � neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficult�; is necessary to <br /> preserve a substantial property right of the applicant; and � <br /> would be in keeping with the spirit and intent of the Zoning <br /> , Code and Comprehensive Plan of the City. <br /> CONCLIISIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby <br /> � grants a variance to the . Municipal Zoning Code Section 10.24, <br /> Subdivision 5 (B) to permit the construction of a new residence on a lot <br /> of 31,20Q square feet in area instead of the required 43,560 square <br /> feet, and to approve a side street setback of lE� feet where 35 feet is <br /> required, and approve a front setback of 26 feet from the dedicated <br /> right-of-way where 35 feet is required, subject to the following <br /> conditions: . . <br /> 1. Applicant must dedicate by quit claim deed additional <br /> right-of-way including portions of the shoulder, on the <br /> north side of the property along and over the travelled <br /> portions of "Lafayette Avenue" . <br /> 2. Applicant must grant a utility easement surrounding the <br /> existing manhole and sewer lines at the southeast corner of <br /> the property. <br /> 3.
