. <br /> The new house at 1423 Park Drive was constructed to comply with the City of Orono hardcover <br /> regulations. These regulations are inplace to limit the amount of stormwater runoff from building <br /> projects. Drainage swales were constructed on this property to drain the water past the new <br /> house, and your house, at which point the water follows the exisiting historic drainage pattern to <br /> the northeast. A recent field inspection confirms that there is a draintile system that drains water <br /> from the new house to the lakeshore yard with an outlet 10' foot from the property line where the <br /> water then continues to drain downhill to the northeast. In your letter you requested that the <br /> draintile outlet be directed down the steeper hill towards the lake that is located on the subject <br /> property, so as to keep the water on this property. This solution is not desirable because of the <br /> steeper slope is more subject to erosion,and it is also a change from the historic drainage pattern. <br /> The contours on the attached maps show a historic drainage pattern to the northeast across your <br /> property with a relatively flat area at the bottom of the hill, adjacent to the lake, on the northeast <br /> corner of your property. It is quite possible that during heavy rainfall events, or wet periods when <br /> the elevation of Lake Minnetonka is higher that the lower are of your property could be wet at <br /> times. <br /> In summary, our position is that the City has taken adequate and reasonable steps to limit <br /> drainage impacts related to the new house construction at 1423 Park Drive and has no further <br /> legal responsibility in regards to this issue. The intent of the City code is to minimize adverse <br /> drainage impacts from projects, and this has been accomplished by conveying the water past the <br /> houses to minimize the potential for building property damage. Once the water is past the <br /> houses,the existing drainage pattern to the northeast is maintained. The City code does not <br /> require altering existing drainage patterns in order to unnaturally force all of the water to stay on <br /> a certain property in order to prevent wet areas on adjacent properties. The intent of the code is <br /> to protect structures from water damage while maintaining existing drainage patterns. <br /> Thank you for your assistance in this matter.
