The City Councii has considered this application including the <br /> findings and recommendations of the Planning Commission, reports by <br /> City staff, comments by the applicant and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this <br /> . property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard <br /> or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a demon- <br /> strable hardship or difficulty; is necessary to preserve a substantial <br /> property. right of the applicant; and would be in keeping with the <br /> spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> CONCLIISIONS, ORDSR AND CONDITIONS � <br /> • Based upon one or more of the findings notecl above, the Orono <br /> i City Council hereby grants variances to Municipal Zoning Code Sections <br />� 10.22, Subdivision 1 & 2; 10.55, Subdivision 8; and 10.24, Subdivision 5 <br />; ' (A) & (B) to permit the construction of additions to the existing residence <br />; which will result in 4.9$ hardcover in the 0-75' lakeshore setback zone <br />� where no hardcover is normal ly allowed, a 31' defined building height where <br /> ; only a 30' maximum building height is normally a1l.owed, encroachment of <br /> ' structure past the defined average lakeshore setback line where no <br /> � encroachment is normally allowed, encroachment of deck structure to within <br /> ' 67' of the shoreline and portion of the house 74' from the shoreline where <br /> a 75' setback for all structures is normally required, and continuation <br /> upward of a substandard 1.8' side setback where a 10' side setback is <br /> normally required, subject to the following conditions: <br /> 1. Hardcover in the 0-75' zone is limited to the following: <br /> i <br /> � New Deck & Stairway 264 s.f. <br />.; Portion of House 10 s.f. <br /> t <br /> 1 <br />.� TOTAL 2 7 4 s.f. (4.9�) <br /> ; . Applicant is advised of the 25$ and 30$ hardcover limitations in the <br /> � 75-250' and 250-500' lakeshore setback zones respectively. No <br />�,� additional hardcover will be allowed in the 0-75' lakeshore setback <br />.:� . zone. ' <br /> � • 2.
