This application was reviewed as Zoning File 07-3283. <br /> 2. The property is located in the LR— 1B, Lakeshore Zoning District which <br /> requires a minimum lot area of 1.0 dry acres and a minimum lot width of <br /> 140' feet. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on April 16, 2007 and recommended approval of the hardcover <br /> variance and conditional use permit based on the following findings: <br /> a. Other than the average lakeshore setback, the proposed addition and <br /> home will meet the Zoning Ordinance requirements with respect to <br /> setbacks, lot coverage by structures, and building height. <br /> b. The retaining walls and addition will have no negative impacts to <br /> views of the Property as viewed from the lake. <br /> c. No neighbor's views of the lake will be affected as a result of the <br /> average setback variance. <br /> d. Replacement and reconfiguration of the retaining walls is necessary to <br /> allow for adequate pedestrian access to the residence. <br /> 4. The City Council has considered this application including the findings <br /> and recommendation of the Planning Commission, reports by City staff, <br /> comments by the applicants and the public, and the effect of the proposed <br /> variance and conditional use permit on the health, safety and welfare of <br /> the community. <br /> 5. The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variance and conditional use permit would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard or other <br /> danger to neighboring property; would not merely serve as a convenience <br /> to the applicants, but is necessary to alleviate a demonstrable hardship or <br /> r�;f_fi_r.,,ltv� i.g nPr.Pccary tn prPCPryP a c»hgtantial prnne,rtv ri�ht of the <br /> Page2 �f5 <br />
