Fairbank and Pats} <br /> Fairbank filed a petition wi�h the City of Orono requesting the vacatior <br /> . of a portion of Forest Boulevard originally dedicated in the Plat of Sag� <br /> Hill Revised legally described as follows: <br /> That part of vacated Forest Boulevard as dedicated in <br /> the plat of "Saga Hi� l Revised, Hennepin County, <br /> Minnesota" which lies between the Northwesterly <br /> extensions across it of the Southwesterly line of Lot <br /> 15, Block 6 , "Saga Hill Revised, Hennepin County, <br /> Minnesota" and the Northeasterly line of Lot 13 , said <br /> Block 6; and <br /> WHER$AS, after due published and posted notice, a public hearin� <br /> was held before the City Planning Commission on March 21, 1988, regardin� <br /> said vacation and all interested persons were given an opportunity to b <br /> heard; and <br /> WHEREAS, after due standing and consideration, the Plannin <br /> Commission recommended approval of the requested vacation and the Counci <br /> of the City of Orono finds that said vacation as proposed, is in keepin <br /> with the public interest in consideration of the fol lowing findings: <br /> 1. The vacation does not affect the access or the use of adjoinin <br /> properties . <br /> 2. The City has not and does not intend to develop, improve, or us <br /> the dedicated right-of-way of Forest Boulevard for road purposes. <br /> 3. The City has not and does not intend to maintain or instal <br /> utilities within the dedicated right-of-way of Forest Boulevard. <br /> 4.
