' r � <br /> � <br /> � O� <br /> O O CITY of ORONO <br /> a �+ RESOLUTION OF THE CITY COUNCIL <br /> �' 6346 <br /> �� �, �,�' NO. <br /> �9k'Es8o4� <br /> A RESOLUTION APPROVING <br /> A SUBDIVlSION OF A LOT LINE REARRANCEMENT <br /> AND EXTINGUISHMENT OF THE CONDITIONAL USE PERMIT <br /> GRANTED WITH RESOLUTION NO.4836 <br /> FILE NO. 13-3640 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, the City Council of Orono (hereinafter "City Council°) has adopted <br /> subdivision regulations for the orde�ly, economic and safe development of land within the City; <br /> and <br /> WHEREAS, James Murphy and Sandra S. Smith, a married couple(hereinafter <br /> the "Applicants") are the owners of the property located at 20 Orono Orchard Road Id within <br /> the City of Orono (hereinafter"City") and legally described as follows: <br /> Lot 13, Block 1, Orono Oaks, Hennepin County, Minnesota (attached) (hereinafter "the <br /> 20 ParceP'); and <br /> WHEREAS, the Applicants are also the owners of the property located at 30 <br /> Orono Orchard Road N within the City and legally described as follows: <br /> Lot 10, Bfock 1, Orono Oaks, Hennepin County, Minnesota (hereinafter "the 30 Parcel"); <br /> and <br /> WHEREAS, the Appficants have submitted an application for a lot line <br /> rearrangement involving the 20 Parcel and the 30 Parcel which would relocate the lot boundary <br /> line between the properties; and <br /> WHEREAS, in July 2002, Resolution No. 4836 was adopted by the City Council <br /> and granted approval to the 30 Parcel for the keeping of 3 horses on the 30 Parcel where <br /> adequate pasture acreage to support 3 horses did not exist; and <br /> WHEREAS, after due published and maiied notice in accordance with Minnesota <br /> Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono <br /> Planning Commission held a public hearing on the lot (ine rearrangement on November 18, <br /> 2013 at which time all persons desiring to be heard concerning this appfication were given the <br /> opportunity to speak thereon; and <br /> .
