. ,� Sec.13.04 RIGHTS OF S[TBJECTS OF D.�►TA Subd. 1. Type of data. The rights of individual on whom the data is stored or co be stoced shall be as set forth�this section. Subd.2. Information reqirired to be given individual. An individuai asked to supply private or confidendal dan�nceraing himself shall be informed of: (a)the purpose and intended use of the requested data within the collecdng Srate agency,pofiucal subdivision,or satewide system; (b)whether he may refuse oY is legally required to supply the requested data;(c)any lmown consequence arising from his supphmg or isfiising to supply private or confidential data;and(d)the idendty of o[her persoas or enuaes authorized by state or fedecal law to receive the daa. This requiremeat shall not apply when an individnal is asked[o supply investigadve data,punuan[to section 13.82,subdivision 5,w a law enforment officer. The commissioner of re�enue mav place the nodce rewircd under this subdivision in the individual income rat or provem ta�c tefund insnvcaons instead of on those forms. Subd.3. Access to data by individual. Upon request to a responsibie authority,an individual shall be informed a•he[hez he is the subject of stored data on individuals,and wherher it is ctassified as public,private or co�dendal. Upon his further iequest,an ind:tizdua!who is the subject of stored private or public data on individuals shall be shown che data wichout any charge to him and,-if he desires,shall be informed of the content and meaning of rhat data. After an individual has been shown the private data and informed of its meaning,rhe data need�c 6e disclosed to him for six months thereafur unless a dispute or acdon pursuanc to this secdon is pending or addidonal data on the individual has b�n coilected or cnated. The rosponsible authoriry shall provide copies of the private or pubiic data upon request by the individual subject of the dara. �e responsible authority may require the requesting person to pay[he actual costs of making,certifying,and compiling the copies. The responsible authoriry shail compiy immediately,if possible,with any request made pursuant to this subdivis�cn,or widiin five days of the date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannet�mpty with the request within that time,he shall so inform the individual,and may have an addiuonal five days within which to comply with the rec�:�,ezc!uding Saaudays, Sundays and legal holidays. Subd.4. Procedure whea data is not accurate or complete. An individual may contest the accurncy or comple�aess of public or private data concerning himself. To exercise this right,an individual shall nodfy in wridng the responsible authority describing�he na-�ie of the disagreement. The responsible authoriry shall within 30 days ei[her: (a)correct the data found to be inaccurau or incomplete and attempc ril nodfy pasc recipients of inaccurate or incompkte data, including recipiencs named by[he iadividual;or(b)nodfy the individual that he believes t�e'ata co be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determinadon of the responsible au[horiry may be appealed pursuant to the provisions of the adminisaarive:rocedure act reladng to wntested cases.
