However there is a <br /> concem regarding the wetland disturbance which has occurred near the � <br /> lakeshore of the property. <br /> As per the plan submitted to our office on October 19, 2004 you will be <br /> disturbing approximately 387 square feet and per the letter submitted from <br /> eoard ot�ana�s Bollig 8� Sons, INC on October 27,2004 you will be excavating approximately <br /> Pamela Bllxt 48 cubic yards. A permit for erosion control woutd be required if as a part of <br /> . your plan you were disturbing 5000 square feet and/o�50 cubic yards of <br /> Jemes Calkins material or more_ If the scope of the project changes, please contact MCWD <br /> �ance�isher to determine if a permit will be required. <br /> Susan�oetz The MCWD also has expressed a concem regarding the sofl disturbance and <br /> Richard Miller vegetation removal which has occurred along the lakeshore of the property. A <br /> �Ed�el Smith site meeting was also held on OcEober 27, 2004 to discuss with Jon <br /> Swartzman the landawner and his landscape representative the extent of the <br /> scottThomas work of the potential violation of MCWD and Wetland Conservation Act <br /> (WCA) rules chapter 8420. Site review and investigation of the districts <br /> Function and Value Assessment of all wetlands down to a quarter acre in size <br /> indicates there is a fringe wetland located along the lakeshore of your <br /> property. <br /> The site review indicated that there was site grading and vegetation removal <br /> which has occurred within the wetland boundary. MCWD is requesting that <br /> wetland delineation be completed to determine the wetland boundary and ' <br /> dete�rnine the extent of the wetland disturbance. Once a delineation is <br /> completed the MCWD request that the area that has been disturbed within . <br /> the wetland boundary be restored with wetland vegetation and that the <br /> sprinkler system be removed from within the wetland boundary. <br /> In order to avoid further enfarcement action MCWd requests the wetland <br /> delineation be completed by November 9, 2004. The delineation may need to <br /> be recertified in the spring since the growing season ended on October 15� <br /> 2004. Once the boundary has been approved by the MCWD the landowner <br />
