The property is located in the RR-1B Zoning District, where 2 acres or 87,120 <br /> s.f is the minimum lot area. The property consists of 38,346 s.f. <br /> 3. The Planning Commission reviewed this application on May 17, 1999 and <br /> recommended approval on a vote of 4 to 0. <br /> 4. The Planning Commission made the following findings of fact: <br /> A. The lot was developed prior to the adoption of the zoning ordinance. <br /> B. A detached garage is located over the north property line. This non- <br /> conforming structure will be removed before construction begins. <br /> C. The addition will only encroach 2.1' closer to the property line. <br /> D. The alley is not located entirely within the platted right-of-way creating <br /> a greater distance for safe maneuvering of vehicles. <br /> E. Only one additional property (540 Orono Orchard Road) requires the <br /> alley for access. <br /> F. The City maintains the alley as a public right-of-way and has no <br /> intention to relocate the alley. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> Page 2 of 5 <br />
