The property is located in the RR-1B Rural Residential <br /> Zoning District requiring 2 acres of dry buildable area. <br /> The total property consists of 38,377, s.f. or .88 acres. <br /> 3. The Orono Planning Commission reviewed this application on <br /> June 15, 1992 and recommended approval of the proposed <br /> variances based upon the following hardships and findings: <br /> a) The building envelope defined by public rights-of-way <br /> is less than 1/2 acre in area and subject to RR-1B, 2 <br /> acre rural standards. <br /> b) The existing house is located within substandard <br /> setbacks from the adjacent right-of-ways. <br /> c) Current detached garage encroaches Dickenson Street <br /> right-of-way and creates hazards for users of Dickenson <br /> Street and adjacent alley. The structure limits <br /> sighting distance and is a potential hazard for users <br /> of public road. <br /> d) The location of the existing garage in relation to <br /> crest of the hill and adjacent accesses. <br /> e) The location of mature trees to the south of the existing <br /> residence. <br /> f) Persistent surface runoff/drainage problems that <br /> necessitate the retention of a low depression or <br /> retention area within the south yard of the property. <br /> 5. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to <br /> other property in this zoning district; that granting the <br /> variance would not adversely affect traffic conditions, <br /> light, • air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate <br /> a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicants; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> Page 2 of 5 <br />
