The Planning Commission made the following findings of fact:
A. The guest house will not exceed the "2 acre per dwelling unit" density for
properties in the RR-1B zoning district.
B. The guest house meets all required principal building setbacks.
C. A septic system was replaced that is designed to handle the wastewater for
both the principal residence and guest house.
D. The justification for allowing the second oversize accessory structure is that
detaching the garage would meet the letter of the code but would result in
greater visual impacts due to a less compact guesthouse/garage combination.
5. The City Council finds that granting a conditional use permit to allow a guest house
will not be detrimental to the health, safety or general welfare of the public, would
not adversely affect light, air nor pose a fire hazard or other danger to neighboring
properties, nor will its use depreciate surrounding property values and that the
proposed level of use of the property will be in keeping with the intent and objectives
of the Zoning Code and Comprehensive Plan of the City.
6. The City Council finds that the conditions existing on this property are peculiar to it
and do not apply generally to other property in this zoning district; that granting the
variances would not adversely affect traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicant, but is necessary to alleviate a demonstrable hardship or
difficulty; is necessary to preserve a substantial property right of the applicant; and
would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
7. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments by
the applicant and the effect of the proposed variance on the health, safety and.weltare
of the community.
