The Planning Commission made the following findings of fact: <br /> A. The guest house will not exceed the "2 acre per dwelling unit" density for <br /> properties in the RR-1B zoning district. <br /> B. The guest house meets all required principal building setbacks. <br /> C. A septic system was replaced that is designed to handle the wastewater for <br /> both the principal residence and guest house. <br /> D. The justification for allowing the second oversize accessory structure is that <br /> detaching the garage would meet the letter of the code but would result in <br /> greater visual impacts due to a less compact guesthouse/garage combination. <br /> 5. The City Council finds that granting a conditional use permit to allow a guest house <br /> will not be detrimental to the health, safety or general welfare of the public,would <br /> not adversely affect light, air nor pose a fire hazard or other danger to neighboring <br /> properties, nor will its use depreciate surrounding property values and that the <br /> proposed level of use of the property will be in keeping with the intent and objectives <br /> of the Zoning Code and Comprehensive Plan of the City. <br /> 6. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district; that granting the <br /> variances would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicant,but is necessary to alleviate a demonstrable hardship or <br /> difficulty; is necessary to preserve a substantial property right of the applicant; and <br /> would be in keeping with the spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> 7. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission,reports by City staff, comments by <br /> the applicant and the effect of the proposed variance on the health,safety and.weltare <br /> of the community. <br /> Page 2 of 7 <br />
