I 1123 4- <br /> 11140q%1 <br /> 1 0€4(7Q 3 <br /> 1 Igo 0474 <br /> ii?‘) 0k Ioctocit 7 <br /> 0 ei41' 7Ig <br /> Aa CITY of ORONO i012-37 <br /> .4 '; ir4,G� RESOLUTION OF THE CITY COUNCIL <br /> 44-ESH.0v NO. 5 5 9 g <br /> A RESOLUTION VACATING <br /> CERTAIN DRAINAGE AND UTILITY EASEMENTS <br /> WITHIN THE PLATS OF <br /> CRYSTAL CREEK; MEYER DAIRY ADDITION; <br /> SPRUCE ACRES; ORONO OAKS; AND WOOD END ACRES <br /> IN THE CITY OF ORONO, <br /> HENNEPIN COUNTY, MINNESOTA <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, as part of the MnDOT Highway 12 relocation project, the <br /> Minnesota Department of Transportation (MnDOT) acquired certain residential properties, <br /> portions of which will become owned by the Burlington Northern and Santa Fe Railway <br /> Company(BNSF) for railroad right-of-way purposes; and <br /> WHEREAS, as part of the pending ownership transfer, BNSF has required <br /> MnDOT to have existing drainage and utility easements vacated within the new railroad right-of- <br /> way where they no longer have any public purpose; and <br /> WHEREAS, on March 21, 2007, Lee Williams on behalf of MnDOT (hereinafter <br /> the "petitioner") filed a petition and application with the City of Orono (hereinafter "the City") <br /> requesting the vacation of certain portions of the Drainage Easements and Drainage & Utility <br /> Easements dedicated within Outlot B, CRYSTAL CREEK; within Lots 3, 4, and 7, Block 1, <br /> MEYER DAIRY ADDITION; within Lots 1, 2, and 3, Block 1, SPRUCE ACRES; within Lots <br /> 1, 2, 3, 4, 5, and 6, Block 1, ORONO OAKS; and within Lots 1 and 2, Block 1, WOOD END <br /> ACRES; and <br /> WHEREAS, the portions of said Easements to be vacated are formally and <br /> legally described in Exhibit A attached hereto; and <br /> WHEREAS, after due published and posted notice, a public hearing was held by <br /> the Orono City Council on April 9, 2007 regarding said vacations and all interested persons were <br /> given an opportunity to be heard; and <br /> 1 <br />
