The property exceeds 1.99 acres and is not subject to the structural lot <br /> coverage limitation of 15%. <br /> c. The proposed structure complies with all setback requirements. <br /> d. Based on the 9.45 acre area, the property is permitted 6,000 square feet of <br /> accessory structures. Four, 999 square foot buildings (10 feet apart) could <br /> legally be constructed on the property. <br /> e. The 3,000 square foot accessory building is proposed to be used as a riding <br /> arena and will not be used to house animals. <br /> f. Considering aesthetics, the applicants have proposed to construct one <br /> additional building, 3,000 square feet in area, on the property rather than <br /> construct four, 999 square foot buildings. <br /> g. The applicants agree to limit their property to 4,200 square feet of accessory <br /> structures as part of the variance approval. <br /> h. The proposed building is proposed to have a maximum of 12' sidewalls. <br /> i. The applicants agree to the filing of the OAS covenant. <br /> j. The project will trigger the wetland buffer and other requirements of the <br /> City's wetland regulations. With the issuance of a building permit the project <br /> must comply with Sections 78-1600 through 78-1614. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments by <br /> the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variance would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a demonstrable <br /> hardship or difficulty; is necessary to preserve a substantial property right of the <br /> Page 2 of 5 <br />
