The City Council finds the building size required is consistent with the intended use
of the building. The applicant has stated the reason to construct a building with a
minimum size of 36 feet wide by 60 feet in length is necessary to permit storage of
a 56'truck and trailer used for a private business. Without the additional length and
width it would not be possible to park the vehicle indoors.
6. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
7. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variance on the health, safety and
welfare of the community.
CONCLUSIONS, ORDER,AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants
variances to Municipal Zoning Code Section Section 10.03,Subdivision 9(C)to permit construction
of a 2,160 s.f.pole barn(60'X 36')where 2,000 s.f.is allowed,and Section 10.03,Subdivision 9(D)
to permit the existing garage to be relocated on the property 72.9'from the north property line where
100' is required.
Approval is subject to the following conditions:
1.
