Based on <br /> discussions with him and upon revie a e corres -ence between yourself and the City of <br /> Orono, the following points are noted: <br /> It is very probable that activities of adjacent property owners have restricted the drainage <br /> between your parcels of property. In an effort to restore the drainage to the previous condition, <br /> existing tile line could be re-established. <br /> Restoring drain tile to the previous condition is addressed under exemption 3 of the Wetland <br /> Conservation Act and would not require a watershed district permit. This exemption states that a <br /> replacement plan is not required for `activities necessary to repair and maintain existing public <br /> or private drainage systems as long as wetlands that have been in existence for more than 20 <br /> years are not drained' (see attached). <br /> This letter qualifies as your exemption from the WCA if you proceed with re-establishing <br /> existing drain tile.
