Prior to the issuance of a final Certificate of Occupancy, the Applicants shall <br /> submit an "as-built" survey reflecting compliance with all of the zoning district <br /> requirements as well as City Engineer's recommendations including but not <br /> limited to the following: <br /> a. The submittal included an as-built survey dated 7-16-07. The contours <br /> shown along the lot lines on the 7-11-07 design plans do not match the <br /> submitted as-built plan. Generally, the proposed contours are higher than <br /> the as-built contours generating a concern of the need to create steeper <br /> than allowed slopes or grade across lot lines. This needs to be resolved. <br /> b. The design plans show 2:1 slopes on the downhill side of the pond. These <br /> grades must be modified to 3:1. <br /> c. The design plans should show contours below the 10:1 bench showing the <br /> overall depth of the pond. <br /> d. The grading plan must be revised such that no grading occurs within five <br /> feet from property boundaries. <br /> 3. Authorities granted by this resolution run with the Property not with the <br /> applicants, but are permissive only and must be exercised by obtaining a building <br /> permit for the new construction within one year of the date of Council approval, <br /> or the conditional use permit will expire on that date(September 10, 2008). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> 5. The undersigned Applicants have read, understand and hereby agree to the terms <br /> of this resolution and on behalf of the Applicants and the Applicants' heirs, <br /> successors and assigns, hereby agree to the recording of this resolution in the <br /> chain of title of the Property. <br /> Page 3 of 5 <br />
