CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. 6 8 5 2 <br /> "lKES H 01:c. <br /> A RESOLUTION <br /> APPROVING A VARIANCE FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-350, 78-1680, 78-1279 <br /> FILE NO. LA18-000019 <br /> WHEREAS, on March 2, 2018, Mark Williams o/b/o Mary and Mark Enger <br /> ("Applicants"), applied for a variance from the City Code for the property addressed 2697 Casco <br /> Point Rd and legally described as: <br /> Lot 4, AUDITORS SUBDIVISION 265 Hennepin County, Minnesota (hereinafter the <br /> "Property"); <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279 to allow a new structure for a porch <br /> 66 feet from the OHWL which is within the 75- lakeyard setback; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1680 to allow roughly 126 square feet of <br /> hardcover in the 75- lakeyard setback; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-350 for lot area and lot width; and <br /> WHEREAS, on March 19, 2018, after published and mailed notice in accordance <br /> with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br /> which time all persons desiring to be heard concerning this application were given the opportunity <br /> to speak thereon; and <br /> WHEREAS,on March 19,2018,the Planning Commission recommended approval <br /> of the variances; and <br /> WHEREAS, on April 9, 2018, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> NOW,THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby approves the requested variance as described above based on one or more of the <br /> following findings of fact concerning the Property: <br />
