The Applicant shall conform to the City Engineer's requirements at the time of the building <br /> permit. <br /> 6. Regarding the landscape plan, the Applicant agrees to work with the neighboring property <br /> owner to avoid limiting the light, air, and open space they currently enjoy at 1101 Femdale <br /> Road West. <br /> 7. Hauling shall occur during allowed construction hours only Monday through Friday 7 am <br /> to 8 pm (and between 8 am and 8 pm on weekends and holidays). <br /> 8. The street shall be swept daily, or as needed, to keep debris off of Ferndale Road West. <br /> 9. Contractor(s) shall post a contact number and be able to respond to complaints in a timely <br /> fashion. <br /> 10. Any amendments to The Plans which are not in conformity with City codes may require <br /> further Planning Commission and City Council review. <br /> 11. The Owner agrees to a covenant recorded against the title of the Property providing that <br /> the accessory building will not be: <br /> a) Used for a home occupation unless specifically approved by the city or if <br /> allowed by this Code. <br /> b) Used as a dwelling unless a guest house conditional use permit is obtained. <br /> c) Rented, leased or otherwise provided for use as a dwelling under any <br /> circumstances. <br /> 12. Authorities granted by this resolution run with the Property not with the Owner, but are <br /> permissive only and must be exercised by obtaining a building permit for the new <br /> construction and commencing construction of said project. A framing inspection must be <br /> completed within one year of the date of Council approval, or the approvals will expire on <br /> that date (May 8, 2018). <br /> 13. Violation of or non-compliance with any of the terms and conditions of this resolution may <br /> result in the termination of any authority granted herein. <br /> 14. The undersigned Owner has read, understands and hereby agrees to the terms of this <br /> resolution and on behalf of the Owner and the Owner's heirs, successors and assigns, <br /> hereby agree to the recording of this resolution in the chain of title of the Property. <br /> 9 <br />
