Location. <br /> Except as may be specifically provided, no detached garage or other accessory building shall be located nearer to <br /> the front or street lot line than the principal building on that lot. Detached garages or other accessory buildings on <br /> lots which have frontage on a lake may be located between the rear yards of such lots and the principal building <br /> only if setback requirements of section 78-305(b), section 78-330(b) and section 78-350(b) are met. Detached <br /> garages on lots that have frontage on a lake may be located ten feet from the street or rear lot line when doors <br /> face away from the street and an adequate vehicle turnaround is provided on the site. This section shall not apply <br /> to lakeshore lots that are divided by streets or private roads or are corner lots. <br /> (Code 1984, § 10.03(9)(D); Ord. No. 52 3rd series, §2, 11-24-2008) <br /> Sec. 78-1608. Standards. <br /> The following standards apply to all land within the wetland overlay districts, wetland buffer areas, and to <br /> neighboring lands: <br /> (1) Protection of wetlands and wetland buffer areas. <br /> a. Except as modified or regulated by the standards of this subsection, all requirements of <br /> the underlying zoning district apply. <br /> b. No structures are allowed in the wetland overlay districts, or wetland buffer area except <br /> those allowed as of right or by conditional use permit by sections 78-1606 or 78-1607 of <br /> this article. <br /> c. Activities including, but not limited to, building (other than a boardwalk or dock), paving, <br /> mowing, vegetation removal, filling, dumping, yard waste disposal or fertilizer application <br /> are prohibited, except that certain such activities may be permitted when approved by the <br /> city as a buffer management plan. Invasive non-native vegetation, such as European <br /> buckthorn and noxious weeds, may be removed by obtaining a vegetation removal permit <br /> from the city. <br /> Sec. 78-966. Prohibition. <br /> (a) It is unlawful for any person to perform or have performed the following land alteration activities <br /> without a conditional use permit issued by the council: <br /> (1) Remove, fill, use for fill, dredge, store or excavate rock, sand, gravel, dirt or similar earth <br /> material within the limits of the city. <br /> (2) Fill or reclaim any land by depositing such material or by grading of existing land to <br /> elevate or alter the existing natural grade. <br /> (3) Build, alter or repair any seawall or retaining wall, or otherwise change the grade or shore <br /> of lakeshore property. <br /> (b) All land alterations involving filling and grading shall be performed only with clean fill as defined in <br /> section 78-1. Granting of such permits is subject to other regulations and prohibitions of this Code <br /> and other applicable statutes or ordinances of other governmental bodies. <br />
