The special conditions applying to the structure or land in question are peculiar to such <br /> property or immediately adjoining property. <br /> Response: 1. In 2001, the neighbor to the south at 2715 Casco Point Road, received a lake setback <br /> variance based largely on the hill from the main road to the home and the safety concerns outlined above. <br /> 2. The neighbor to the north at (2695 Casco Point) removed their home several years ago and the drainage <br /> was modified (see survey for drain field). This has caused flooding problems and water runoff issues. Our <br /> intentions are to re-shape drainage to better manage this situation and which would not be feasible if the <br /> home were moved closer to the street in addition to the ?hill safety? argument. <br /> 9. The conditions do not apply generally to other land or structures in the district in which said <br /> land is located. <br /> Response: Not applicable <br /> 10. The granting of the application is necessary for the preservation and enjoyment of a <br /> substantial property right of the applicant. <br /> Response: We are replacing the existing home with a similar home, while improving the site for both <br /> neighbors. <br /> 11. The granting of the proposed variance will not in any way impair health, safety, comfort, <br /> morals, or in any other respect be contrary to the intent of the Zoning Code. <br /> Response: The granting of the variance will not negatively impact the site, but will in fact make it safer and <br /> more suitable than its current condition. <br /> 12.
