April 12, 2010 <br /> To: Zoning andtree files <br /> 1030 Old Crystal Bay Road North(Orono Baseball Association Fields) <br /> From: Evelyn Turner <br /> All the fields are built on land the City leases from the school district and subleases to the Orono <br /> Baseball Association. The west fields were constructed in 1994 after the City Attorney <br /> determined the land was a park(since the lease was for more than 10 years) so the fields were a <br /> permitted use. The east field was approved in 2001 and constructed in 2003. It was granted a <br /> CUP as part of the school as the City was not involved in leasing the land. HOWEVER in 2003 <br /> the lease and sublease was revised so the City leased the land for the east field as well as the west <br /> fields and in turn sublet it to the OBA. The lease was extended to 2024. <br /> This means that the entire complex is considered to be a park and is a permitted use. The lease <br /> lists a number of improvements that are specifically allowed and includes other appurtenances <br /> necessary to operate similar organized your baseball fields in the suburban TC area. The City is <br /> not required to approve improvements, only the school district, but building permits are required. <br /> While the initial lease refers to "little league baseball"the first addendum to the lease changes <br /> this to "organized youth baseball". <br />
