In 1994 the Orono Baseball Association (OBA) constructed the two <br /> existing baseball fields, known as Lee Carlson Fields, on the property. <br /> A Conditional Use Permit was not required for the west 1/2 of the <br /> property. The City of Orono has leased the west V2 of the property from <br /> the Orono School District and further leased the property to OBA. It <br /> was the opinion of the City Attorney that as long as the City was leasing <br /> the property from the School for a period greater than ten years that the <br /> baseball fields would be considered a permitted City park use. The Code <br /> permits municipal uses in the zoning district. <br /> B. The east 1/2 of the property is the proposed location of the new <br /> baseball/soccer field. Since the City does not have a lease for this <br /> portion of the property and it is owned entirely by the School District a <br /> Conditional Use Permit (CUP) is required for the construction. Schools <br /> and their associated facilities require a CUP. <br /> C. In 1999 a CUP for Middle School construction was approved and the <br /> school opened the fall of 2000. A condition of approval for the new <br /> Orono Middle School required the individual properties located east of <br /> Old Crystal Bay Road be combined into one tax parcel. That parcel <br /> includes the baseball fields and Middle School. <br /> D. Access to the new baseball/soccer field would be via an extension to the <br /> existing access from Old Crystal Bay Road. The road will lead to a 48 <br /> stall parking area west of the ball field. In addition, the parking area <br /> will include a turnaround with a 65' radius. The 65' radius is 15' <br /> narrower than a typical cul-de-sac width. The City Fire Marshal has <br /> approved the turnaround width. The width meets the standard for basic <br /> emergency service. <br /> E. City Code requires parking for athletic fields as 1 parking space for each <br /> six seats of capacity. Each 22 inches of bleacher space devoted to <br /> seating is counted as one seat when determining design capacity for the <br /> bleachers.
