Pv 0.iti <br /> O O <br /> ,,,-,,,,t4 <br /> 4. _, CITY of ORONO <br /> ,w, <br /> 14 <br /> s.+ � �ip`�� '��,__ <br /> RESOLUTION OF THE CITY COUNCIL <br /> `�kEs8oly No. 5 7 2 <br /> A RESOLUTION GRANTING <br /> A CONDITIONAL USE PERMIT <br /> FOR LAND ALTERATION WITHIN THE SHORELAND ZONE <br /> PER SECTION 78-966 <br /> FILE NO. 08-3349 <br /> WHEREAS, Independent School District No. 278, a public corporation, <br /> (hereinafter "the Owner") is the owner of the property located at 685 Old Crystal Bay Road <br /> North within the City of Orono (hereinafter the "City") and legally described as Government <br /> Lot 1, Section 33, Township 118, Range 23 West of the 5th Principal Meridian, Hennepin <br /> County, Minnesota; and <br /> WHEREAS, the Owner has made application to the City of Orono for a <br /> conditional use permit per Orono Municipal Zoning Code Section 78-966 to allow deposit of <br /> approximately 15,000 cubic yards of fill material within the shoreland zone; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on February 19, 2008, at which time all persons desiring to <br /> be heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#08-3349. <br /> 2. The Planning Commission reviewed this application on February 19, 2008 and <br /> on a vote of 5 - 0 recommended approval of the conditional use permit for land <br /> alteration. <br /> 4. The City Council has considered this application including the <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the owners and the public, and the effect of the proposed land alteration on <br /> safety and welfare of the community. <br /> Page 1 of 3 <br />
